KARK reported the story tonight & said it was legal. I personally like the policy since I view a hospital as a clean & sterile environment.

I agree that it is a good thing but it is un fair.. When you have people (like myself) who does not smoke.. Never smoked and has no intentions of smoking, but my husband smokes everyday, I can't get a job there because I will have second hand smoke in my system & I will be out of a job due to this new policy. 2nd hand will shop up, I've already called & asked and they just said sorry because they don't know if I am really not smoking or if it's actually my husband. That's not fair. I dont smoke and get punished and can't work there..

daddy wrote: Lol!!! Jw how they can do it legally? The current employees will be grandfathered in. How can that be legal to allow the current employees to continue to smoke but do random screenings on the ones hired after Oct. 1st. That seems unfair and illegal. Shouldn't they make the current employees quit (give them free help to quit) then screen them also?

It isn't illegal as long as they give a 30 day notice and they can grandfather current employees because the policy wasnt in place when they were hired, they cant change midstream on them. As long as you have a written policy in place you can test for whatever you choose to test for and as often as you please. If a potential employee doesnt agree then they dont have to accept the job. And whoever told someone that second hand smoke can make you test positive on a nicotene test was mistaken or is using inferior testing methods. YOU CANT TEST POSITIVE FOR SECONDHAND SMOKE...whether its THC or nicotene. I dont see what the fuss is all about...I dont smoke and sorry but I dont want to smell a nurse coming into the hospital room smelling like an ashtray...

It's legal because it's in the application, you know up front about it just Like with drugs. I'm not a smoker anymore but it may not be fair, I don't like smelling smoke either but it's your choice & Ur harming Ur self. What about drinking, it hurts us to, for sure if u drive or it makes u beat Ur family members when u can't handle it.(some do act bad when drunk) I do belive they are working on getting the currant smokers to quit to. Raising insurance if you smoke, having them not smoke while ST work.. Some children's Hosp. have it where u can not smoke with in so many hours of coming into work, if the smell it you will be fired. That makes more since to me. Because smoke smell can hurt very sick people, babies, children, and one with respotory problems. So it's best for these people to not be around it or be touched by hands with nicotine all over them. Will they do the same for the Drs though? If not then this is not right at all....

I spent several weeks at WCMC due to an accident and I tell you, I'd rather have a smoker that's kind and qualified than some of the non-smokers that work there now. There's already a shortage of health care workers now and many from our area drive to LR already...WCMC you're only limiting the number of quality staff available.

If you've lived in this county for many years, you already know that there's not much that place can do that anyone can stop.

Yes they'll ask on the app. But regardless of what u answer, if ur offered a job the when u go for your pre employment drig screen u get a nicotine screen too. So ALL new hires get tested before they start AND you might get a random at any time n get fired if u have started later.

It's illegal there going to get sued for sure they can't make you not smoke cigs maybe they need to do same thing with alcohol since some of them come to work still drunk I guess you don't have to be a equal opp employer anymore either.

I guess not. Especially if you work in a health facility. But it should include all employees and they should help them all quit before they start screening and give them a limited time to get nicotine out of their systems before they screen their grandfathered in employees. If some can't smoke it should be all.
