Christopher Marina Del Rey, CA	Reply » \| Report Abuse \| Judge it! \| #2 Nov 8, 2010 Your employer can only be held liable for creating a hostile workplace if the hostility is directed at your race, color, religion, national origin, disability, genetics, age or sex, or if it arises as a form of retaliation in violation of a discrimination law. If your boss is just an a_hole, you have no recourse. Find another job and take down the company server on your way out.

So in that instance the person is really forced out; that is a claim that can be made. If she is not forced out because of some protected class she should still be able to pursue the employer. She just should make sure someone there in a position to do something about it knew but did nothing or did not resolve it and the harassment continued.

What about bosses like a high level US Bank corporate officer named Benjamin Schuerman that physically threatened employees at this company I worked for named CACi that was in charge of the collections department of US Bank? He, along with another very high level boss named Richard Marks also sexually harassed the single women there and then intimidated the boyfriends if they dared to speak up for their women.
