Homeowners facing foreclosure in Osceola County may be shut out of a process that could have provided some relief to them, because the judge who oversees their cases opposes it.

How does the government step in and force mediation anyway? Isn't a mortgage between two private parties? Mortgages are very specific on the actions taken when in default. Sounds to me like the government can trample anyone's rights it wants to and say...."here is what WE say is best". Sorry....stay out of it.

Osceola judge is correct. His job is to sit on the bench and determine what the correct rule of law is and make sure it is followed. Judges or in this case my dear friend Chief Judge is incorrect. He can not and should not try to legislate or creat law. Belvin has done a fine job over the years and perhaps it's time to run for the state House if you feel compelled to legislate. Forclosure is pretty cut and dry. Borrower receives loan from lender. Borrower fails to pay. Lender takes property back by forclosure. Lender sells to someone else. It's that simple. It's the rules. While everyone in this terrible position of forclosure and loosing your home feel like the government, the rock star cool new president to name a few should give you something for nothing, including now the local chief Judge, this is simply not the rules. And don't forget about the 90% of Americans that didn't buy what they couldn't afford or fake their mortgage applications to buy their home, that will be harmed by yet another giveaway to help those that can't help themselves.

What about the people who lost their jobs or got a decrease to keep it. There are hundreds of vacant homes in kissimme. Unoccupied property. As a realtor I can tell you the qualifications to buy a home are very regid now,. These homes sit empty. I have had new homes being vandalized. This in no good. We need to help the home owners. Taxes are rising the cost of living and jobs are declining. READ THE NEWS. The average Joe is not sitting on a bench dictating what should be done , they are struggling to raise a family, to keep the sheltered. Mr: Judge the is a judge above you. Just remember that. You are in a place of authority to help not hurt average people. Law obiding people.Single moms, widows, the elderly, MAIN STREET....

Why not help. Is that not what everyone else is trying to do?. Come election time we will remember. The average Joe can be you or me. We need to treat everyone the way we would want to be treated. Those empty homes will be a shelter for trouble and crime.

In my neighborhhod there are over 25 vacant homes . They have been that way for a very long time. If they had helped the home owners they would not be empty . They sit there month after month. If this was your neighborhood Judge you would be thinking as one of us. Let them stay in their homes and keep the yards and the value of the neighborhood will be increasing not decreasing. The home owners keep better care of their homes. The circumstances will be more damaging with empty homes.

There is no free lunches. If you can't afford to buy a home you shouldn't have done so. Making a false mortgage application to gain a home has caught up with many. A judge has no authority to make rules in forclosure cases. His job is simply to follow the rule of law. If you want help, ask your parents. That's their job, not the Government.

Personal responsibility. If you took out a loan, it is your responsibility to repay it. It is NOT the responsibility of society of government or the citizens to bail you out. It's caller PERSONAL RESPONSIBILITY!!! You are responsible for your actions, no one else.

I agree with the judge in Osceola County. The way the mediation rule is written, it totally favors the lendor. A smart homeowner will bypass this travesity of law.

What about CORPORATE RESPONSIBILITY!!!! Should the lender not be held responsible for their part in creating this foreclosure crisis. Let's be fair, lenders are just as responsible, if not more responsible for this mess. In the era of deregulation where no one was watching the hen house, the lenders created these unsustainable variable rate mortgages with teaser rate to attract unsophisticated consumers, without performing no due diligence to determine the borrowers ability to repay the loans (i.e. no docs loans) and act surprised when the loan foreclose when the loan rate reset to astronomical rates which the borrowers can't afford. If anyone should be held responsible, it should be the greedy lenders.

There are some that it has not been taking on account. What about the job are being losing around the nation. Who finally will pay the higher cost of those fraud loans. H4H is not accepted by the banks but all of us and our children will pay with our taxes the billions helping AIG (insurance mortgage company)which insure the payments to lender; and lenders in program dont working.

Why the government does not enforce to lender to help homeowner in this situation. I help you and you help them. This is our money going to wrong places.
