Does anyone have any knowledge of the Warner case?

I went to visit with Mr. Warner, outside the Four Seasons Mall this morning. I arrived just as 3 police cars with lights flashing pulled up.

The police officers were very polite, and to a certain degree they understood that they were dealing with a grieving father. I commend them on their patience and professionalism.

But they may not have truly understood what trying to seek justice in a county which - historically - has never offered justice to the victims of crime, amounts to.
Especially murder.

Judge Lines was called, and an order for Mr.Warner to take down all the signs on his vehicle was made.
Even the ones taped to the doors which have clearly been there for a considerable time.

It's my understanding that anyone can post anything they want on their own vehicle under the First Amendment to the United States Constitution.

I'm sure that Judge Lines decision is going to fall under the new village ordinance banning people to ask for donations, but one would think that the 2nd Amendment would over rule a village ordinance. Especially for those fliers posted on Mr.Warners truck door, which is private property.

Why do people ask for donations when they have become a victim of such crimes as murder?

The answer is very simplistic.

Walk into a local bank armed to the teeth and mow down a dozen people with a machine gun and Gary Mitchell will be right by your side defending you.

Have a daughter or son stood in the same bank when that criminal mows them down with a machine gun and good luck finding an attorney.

You have now entered a system which will protect the criminals and further victimize the victims, where wrong is called right, and right is called wrong.. and the whole world goes topsy turvey.
Investigations are not cheap. Legal help isn't free. There are no court appointed attorneys for victims seeking truth.

And it's the loneliest walk any human being can step onto. I just can't imagine what it would feel like to take this walk while grieving for a son or daughter.

This morning my heart simply bled for this man and his family.

As I drove away I thought about Clyde Snow, who has roots in Lincoln County and attended the military school in Roswell.

Clyde used to come to Lincoln County on a regular basis, but in recent years I have not seen him around and I doubt that, at his age, he is taking any more cases.

But the powers that be clearly need to do something - and do so quickly.

If this father is in error he needs peace of mind and the Ruidoso PD have a moral obligation to satisfy, beyond a shadow of doubt, all questions and discrepancies that have caused this scenario.

If this father is not in error, and his son was in fact murdered and robbed, this case needs re-opening, re-investigating, and an independent forensic anthropologist needs to be involved.

The Ruidoso Police were once again sloppy and unprofessional and they want David to go away. He doesn't need to go away. The guys in investigation are there because they are friends of the chief and they brown nosed their way into that position. There are much smarter and more capable officers in the department who do not investigate because they can't get a promotion because they don't blow Red. When the dust settles on this one, the incompetence of Wolfie's department will be public knowledge. The Chief is so incompetent that there is only one place for him to go, the Sheriff's office.

We can't let Mr. Warner go away, and we - as a community - must stand by him. It's the only moral thing to do.

I went to talk to Eddie Fowler to see if he would allow him to park his truck on the edge of his car park at WPS, which would have placed the vehicle on private property and out of the jurisdiction of law enforcement.
But Eddie Fowler wasn't there and an alcohol salesman was being a hard nose telling the manager that she should keep out of it.


I did a web search and the ONLY things that came up was a post Mr.Warner wrote October 11th on another forum..

" i would like to know if you all would do a story of the shooting death and robbery of my son Davis Warner. we live in ruidoso new mexico in lincoln county where the infamous billy the kid lived. to date is is known that there has never been a murder solved here in lincoln county and being that this is the 21st century i feel we have to change this. the police did not do finger prints of the gun used in the shooting of my son nor did they run the serial number and they closed the case before an autopsy was done. if you are interested let me know. thank you david w. "

The officer who investigated this was present this morning.

Mr. Warner is incredibly polite and respectful under the circumstances.

October 11th to June 27th and the man is still stood alone. He earned my respect as a parent this morning, and I sobbed buckets as I drove back on Mechum.

This is a sad, sad story and a fine showing of injustice in our town.

While they may be able to chase him off the sidewalk and away from tourists, he has every right to have his signs on his truck. By law, they should not be able to make him remove them.
Freedom of Speech is still a right in our Country.

Thanks for posting the name of the Judge that sent the order for him to remove the signs from his own truck. Trust me, this is being investigated.

IT is a sorry state of affairs when a grieving father is prosecuted and murderer's are not. We should all stand with them and we should hand out flyers. All three parents whose children's murders have not been investigated should stand together and we should stand with them.

The real part of this story is that the local PD didn't like having their undies aired out on Topix. When does this judge run for reelection?

Me too! I think we should all unite for this man. Makes me sick to think of the coverup that is going on and that we can have no faith in our police officers to do the job they are paid for. They should all be ashamed!

I took a handful of the fliers from David and told law enforcement that I would hand them out - and if they arrested him they would have to arrest me also.
But David wasn't in the mood for serious conversation. It wasn't the time nor the place. And I know NOTHING about this situation. I have no idea who is right, or who is wrong. And I don't want to step over a line and find that I have been in error.
That is why, when I posted on this forum, I said:

I happen to like Judge Lines, and I didn't want him tarred and feathered, but I strongly disagree on anyone taking away the First Amendment. Judge Lines was reading, what I believe to be "the letter of the law" under the Village of Ruidoso pertaining to solicitation of donations, not the constitution of the United States.
The fliers read:
Davis Warner, Foundation For The Truth
This foundation is set up to help in the investigation into the death and robbery of my son, Davis Warner. It will be used to help pay for legal as well as investigation fee's. It will also be used to help others with similar problems. Any donations you make will be greatly appreciated. Thank you and God Bless.
Donations can be made at any Wells Fargo Bank in the foundation name or send to 329 N. Hemlock Circle, Ruidoso, NM. 88345. E-Mail: rwtreeserv@windstream.net.
I'm unsure if I am allowed to even post this information on this forum, but seeing as it's requested I will do so.
The police officers established some facts that I would be negligent in not stating.
1) They only acted because a complaint had been phoned in. They established that he had been handing out fliers for at least four (4) week-ends and they had allowed him to do so.
2) They understood that he was a grieving father, and handled him with care and concern.
3) The law Judge Lines was using was fairly new. So new that law enforcement were returning to the station to look it up on the books.
4) It was the DONATIONS that has prompted this action. It was not handing out fliers, or being on public property discussing this case. It was the fact that he mentions donations, and I believe that is regarded as pandering under this new law.
But if that is so all none profits would have to stop giving information as to where donations can be made. Tricky situation.

One step forward and two steps back.... Hell, this family is all alone with their grief and nobody is ready to help find out about the circumstances of their kid's death. They have to find out so they try and do just this and "this" costs money.

Wish the police would get their a** in gear and do their job so good citizens would not be forced to ask for donations in order to find the killer of their child.

This is not about blaming somebody for doing or not doing something - this is about justice. Guess this is what Mr. Warner wants.

It is my understanding that he was in Mid-Town a while back and they made him stop there also. I could be wrong but that is what a sympathetic shop keeper told me.

Actually I explained that to the police officers. That ALL he wants is fairly simplistic... he wants JUSTICE.

I was told that there are many ways to get justice, and I explained that there ISN'T. If law enforcement won't enforce the law - and you try to make them - you'd better have a healthy bank account or be in for a rocky road because you will be financially. emotionally, physically and spiritually exhausted.

I know, believe me I know.

But I have not lost a child and will admit that had I been in Mr.Warners shoes I would have been their worst nightmare.

One man going against the system is a task beyond human ability, and I congratulate this man for standing his ground and showing unmovable determination.

But Sunday there was two stood, perhaps the next time there will be 10 people, or 20, or a hundred. And just maybe that reality will make Ruidoso PD reconsider this closed case.. and open it back up again.

When I was defending him one police officer tried to get Mr. Warner to say that they HAD left him alone for 4 week-ends, and Mr.Warner just smiled. I wondered why he didn't give a direct answer to a direct question but that may be the reason.

If Eddie Fowler would allow him to park his truck on either WPS or the other bar car park - which is private property - law enforcement couldn't interfere.

Nancy Canning owns that lot on the corner of Country Club Drive & Mechum and I'm confident she would allow him to use it. But it's too far down to give him access to foot traffic.

How about floats in the upcoming parades?

I know a lot of the biking clubs would sure come to bat for a father seeking justice.

It sure would be a heck of a lot easier for Ruidoso PD to open this case up and do a thorough investigation, and give this man justice. But of course, this is Lincoln County.... lots of Buts & If's here.:(

Justice loving bikers of any stripe would be good. The Ruidoso Police have made many omissions and mistakes both at the crime scene and with witness statements and misstatements. They would only reopen it to try and clean up their mess and do damage control. If anything in this county needs to be investigated you better hire it privately done. If you need drunks rolled, you call the Ruidoso Chief, that is what he was famous for in El Paso.

I would love to hear the police's explanation to "and just what would these different ways of getting justice be?". It's their darn job to investigate a murder case. Can it be they know what happened and who should go to jail? Can it be they are "protecting" somebody/a certain family?- Just guessing, I don't have a clue about the facts but I hate that a family looses their child and the police doesn't even care.

What does that mean - they left him alone for four weekends?- Either what he does violates the law then they have to make him stop it or it is ok and he can continue. So - did they admit that they are "strechting" the law according to their will?

And what is this about "somebody had reported Mr. Warner's performance"? Shouldn't that be an address where the PD could start "digging"? Who would mind what Mr. Warner has on his truck.... those that are in question? I didn't read your posts like "Warner was aggressively begging for donations" I just read it like "he had a poster (or whatever) on his truck that told people he tried to find out about the killer of his son and needed money to do so. Who would feel bothered by that? Nobody is forced to read it less to donate.

I really think a black ribbon on your arms would be a good sign of solidarity but I'm not naive enough to believe that many people would do that. Thanks for posting Mr. Warner's address, I'm gonna send some money.

I think wearing a band of color or a button is a fine idea. I don't know how many would do it but it would show some support to a man seeking justice.

People are pretty hard on business owners who take a stand - even if it's using the parking lot. In this day and time no one can afford to have their business shunned so thats a hard call.
