Judges only approve the authority of cops to search. They can't dictate how cops show up, what they wear, or what kind of car they show up in. Even if some judge did try to do that, it would be pointless because the cops wouldn't have to follow it anyway! I guess that's why judges DON'T DO THIS!

Oh, and the ADA I spoke to worked in Fulton County Georgia for years. The judge is a Magistrate Court Judge in metro Atlanta.

What did they say would happen to a judge that tried to insert a restriction in a warrant? Jail for the judge? A fine? Fired? Do tell?

I called 18 judges and they all agreed that your imaginary judge is full of it. they all said that if a judge does insert a restriction, then the police could fail to follow it and hope it was deemed as a mere "technical irregularity," but all 18 cautioned that:(i) that would be a dangerous game for the popo to play as far as excludability of evidence obtained; (ii) that would be a dangerous game for the popo to play as far as any later civil rights suits were concerned; (iii) that would not be good for local popo/judicial relationships; and (iv) the popo couldn't touch the judge (for example, no appeal of the warrant is available and certainly no criminal or civil liability).

aLL 18 judges also agreed: one more Kathryn Johnston and they are going to fall on the popo like an iron mallet on a ripe grape.

I have been writing search warrants for years. I didn't have to call a judge or an ADA. I am an expert in search in warrants. I only did so to confirm what I already knew.

If you had ever seen a search warrant, you would know that there is no place in the warrant itself for restrictions to like your to be stipulated. Just like there is no where on a marriage license for a judge to stipulate, "the woman must cook dinner every night" or I'm not signing it.
