lol, Yep, I hope they don't think he actually intended to hurt the stupid man. I think he needs to go back to him home country. But, lets take a close look at this: *** A celebrity photographer may seek punitive damages against Keanu Reeves in a lawsuit that alleges ``The Matrix'' actor intentionally hit the man with his car, a judge ruled Monday. *** (It does say alleges, so silva will have to prove it really was intentionally. She's not seeing it as an accident, and that's not good.Dee) *** The lawsuit states Reeves knew who Silva was and that he drove toward him with the intent of frightening him into thinking he was going to be struck, Grimes said. *** (Keanu has admitted he drove toward him, he didn't state he rolled forward towards him, but drove with the intent of frightening. I sure wished he'd have a phone and just called the police. Sure hope Keanu thinks of that for future events.Dee) *** Grimes said she was not concluding that the allegations by Silva against Reeves are true, but only that it was too early in the case for the actor's lawyers to move to strike the punitive damages. *** (Well, as least she said she wasn't say'n that the allegations are true!Dee) *** Silva filed the suit Nov. 5, initially alleging negligence. He later added assault and battery, intentional acts that allow a plaintiff to try and get punitive damages. *** (Man, Keanu should have countered with harassment and stalking if he has been following him around in the first place. And, why did he wait to file the assault and battery in the first place? It seems to me, silva is really only after money.Dee) *** Silva claims his earning ability and job prospects have been diminished because of the injuries he suffered on March 19, 2007, when Reeves wa behind the wheel of a black 1996 Porsche 911 Cabrio that struck Silva on Avenida Tranquila in Rancho Palos Verdes, according to his suit. *** (His job diminished cause everyone knows he's a dumbass who doesn't know when to step out of the way of a running car. lol I guess if he heard a noise in the sky and looked up and saw something heading towards him, he'd stand there watching it cause he's too dumb to know when to step aside as well. lol.Dee) *** Reeves, who was covering his face, pulled away from the curb and ``in a sudden, erratic and dangerous manner drove forward and struck (Silva),'' according to the lawsuit. *** (He covers his face from what? Pictures or filming of him being taking by Silva? Or, were there other photogs there as well? Let's see, he's being blinded, harassed, man, no wonder it was a sudden, erratic and dangerous manner... I wonder if the judge has ever experienced anything like this in her career?Dee) *** The trial of Silva's lawsuit is scheduled to begin Oct. 27. (And the wait begins. At least they allowed time for Keanu to film this movie.Dee)
Yep, if they have it on tape, and if he made the moves the way silva claims, Keanu is screwed! If the courts goes in silva's favor, he may actually face time in jail, or maybe even prison. God, I hope not....... If you believe in Jesus everyone, Pray!

he won't go to jail,:) JMO- Worse case scenario, he'll pay the damages. Punitive damages, from what I understand, aren't awarded often, compensatory damages are more likely. Punitive damages also have a cap, Silva can't just throw out a number, I think it's a certain percent of KR's earnings, and has to somewhat match his injuries, which of course is still more than he deserves.(pray the jury uses common sense and says no to punitives) I know it looks bad, especially in a case that involves a pedestrian and driver, the standard of care is greater for a driver, since the car is more powerful.(I didn't know that Reeves Answer states that he pulled forward with the intent to frighten him) either way, I think that the surrounding circumstances should be taken into consideration.(like the car jerking forward, that doesn't sound right, and like I said before, they need to look at the car, recent car servicing etc)- sudden, erratic, reckless manner: witnesses can help here, if he inched out and Silva moved in front of his car after he started to pull away, that should be taken into consideration. As far as his injuries, earnings and job prospects, he's dangerous, his tactics are going to get him and the agency he works for into trouble. He probably has a huge medical bill, and doesn't want to pay it, jerks usually want to drag others in the mud, because jerks will never accept responsibility for their own behavior. I truly believe that Reeves was not at fault,even if they order him to pay some of the fees. I know that any other person (not like it's going to happen to a non celeb) that has a photographer clicking and flashing away in their face would yell at the SOB to frickin' move, but Reeves was probably harassed, and under stress anyway, I think the reasonableness should be measured with any other celebrity in the same or similar circumstance.(they have to deal with it everyday, how would they handle it?) If Reeves gave him warning to move,(that could be 'move you putz', or wave him away) then I feel Silva should be held responsible for contributing to his own injuries,(contributory/compara tive negligence,assumption of risk) The fact he followed Reeves on his personal time, most likely aggravated the situation, taking photos, standing in front of his car so he can further take distressing photos, c'mon, Silva is a frickin' idiot. What was Reeves to do, smile and say "Thanks for the photo op, love ya guys", that's sick.-ooops went off track- misdemeanor convictions are jail up to a year, felony convictions are a year or more, this isn't a criminal case so I think he's fine.

Yep, dont you think the jury will see that the "knucklehead" was working within a few days of the accident? And do you think they will even here how the other photogs dont like him (his run in with x17)? Will they take this into consideration when desiding the case? Not to mention the Fact that Keanu was reportedly only easing of the side of the curb so how fast could he have been going? 2 to 4 miles per hr, how much did this "knucklehead" get hurt. Hospital records show that Keanu already paid his bills from what Ive heard (maynot be true it was a tabloid after all)? He couldnt have been hurt that bad and he was working yet he wants pay for the "DRAMA" am I right.

I think the jury should know that he was working within days and it will most likely be shown by both sides, especially since Silva's attorney added that into their complaint. They could say, yeah, he was working, but his earnings were considerably less etc, it all depends on their strategy.(Frankly, I think he shot himself in the foot with that one) As far as the x17 beatings, that's hard to say whether or not they will or be able to bring that to the table.(if they can't they should show it anyway for a good laugh)
Even if Keanu paid for his hospital bills, and they acknowledge that 'knucklehead' didn't file a complaint until months later, that doesn't change that the issues will still be Whether Reeves is liable for negligence etc or Whether he's liable for assault and battery, and shift the focus to the events of the evening. They may assign a percentage of negligence on both sides. It's hard to say. I think Reeves attorneys will get as much information they can to take care of him, and 'knuckleheads' attorney will do whatever it takes to get his client some dough. BTW, I remember when it happened and I read the same thing, that the car was barely moving and then Silva threw his sorry butt into the street, b*tching and moaning like a big wuss. A police report is pretty detailed and I'm sure pictures were taken at the scene along with statements from both parties and witnesses. I think knucklehead injured himself to be honest. If Reeves paid- it was for the injuries 'knucklehead' inflicted on himself, because he's a nice guy, not because he admits any fault.

My question: Is knuckleheads attorney working on contingency, if knucklehead is awarded any damages, then he gets paid, if not then he gets nothing? There's his attorney's motivation-money-greed. Is knuckleheads agency footing the attorney bill since it was in the scope of employment.(if not then they are hoping to get a piece of the pie?!money-greed) Are these paps independent contractors, if so then he's responsible for his actions and then his company is released from liability for his actions----it goes on and on in my head.(again these are jmo)
I guess it doesn't even matter unless KR sues him in return. I think Reeves wants to take care of the matter at hand, and then forget about it.

I mean come on, if you are infront of a running car moving towards you; you think one would have sense enough to move out of the way! I mean, like, you hear a nosies and look up and see something coming towards you; wouldn't you have sense enough to step to the side and not just stand there, and then check out what it was after it lands in the first place?

You would think that people would move, when we were kids me and my sister worked on a farm. One day my sister was standing in front of a large round bale of hay that started to roll towards her. She just stood there and watch it roll towards her and then run her over. She was ok but had to suffer teasing for years after.

Ok everyone, I just wrote another letter for the cause of trying to change to laws governing how the paps are doing (harassing and stalking) and asked how we can make them change to protect one's privacy. I explained that I know there is a thin fine line between breaking news, and non breaking news. I explained that I know about the freedom of press rule, and that this is what's needing to change! I also let Connie Sipes, one of our Senator here in Indiana, and someone I actually know; that what can change by making the paps have to have appointments for some of these things that they consider to be news that isn't. I again explained that if we can make these changes, it will actually save and protect people's privacy; and also keep everyone safe, no matter who they are?
I'll keep you informed as to what I find out.

Ahh Gypsy you are funny. But all that means is that anything that keanu says during his interogation that is written or taped can not be released to the public. Basically non of the parties can talk about the case to outside sources or hefty fines will be imposed. Is that clearer?? I am no atty-just relaying what I found out on one of Keanus fan sites. An atty stated that is what she found out.

Hry everyone, it's hasn't said that the judge agreed! But, by this into place, it could mean that Keanu has something that maybe will clear him, and they just don't want the press to twist things around about it. Lets hope. I think the gag should have been in place at the first hearing myself.
