Family of hit-and-run victim files claim against La Crosse County

The children of a 55-year-old pedestrian struck and killed on New Year's Eve have filed notice claiming La Crosse County was negligent in failing to clear the sidewalk of snow, forcing the man into the street.

Why was this guy walking the streets at 10:30 at night? Where were his parents? Lot's of unanswered questions. Was drinking involved? or perhaps it was gang related! The county should lock everyone up during the winter for their own safety.

The two drivers that did hit him must not have had insurance or money, and now they are searching for the cash elsewhere. The lawyers will always follow the money trail.

Maybe you shouldn't walk on a BUSY street (this is a 4-lane road...and the only one that goes from La Crosse to French Island on the south end of the island) at 10:30 in bad weather?!?

I don't know where these kids fall in the family tree, but the Harter family is HUGE is sanitation, and very affluent. I'm sure none of these needs the money...they are just being bloodsuckers...

It appears that even if the first driver had insurance that some lawyer has convinced the family that they "need" to sue. Putting a value on life is hard but going after "deep" pockets just because is not right. The first driver is completely at fault for what happened and should bear the full brunt of the lawsuit. The city and county cannot be out there 24/7 to make sure ALL the sidewalks are cleared for every moment at all times.

Sounds like a frivolous lawsuit to me. I suppose that the people who hit him don't have any money therefore is makes so much more sense to go after to county.

I agree with you, except for the 100% at fault. The guy was IN THE ROAD, rather than on the sidewalk, cleared or not. A driver has a reasonable expectation that there won't be people walking in the road when a pedestrian path is provided.

I'm not saying the driver isn't at fault for leaving the scene (and even partially responsible for the accident), but shifting the perceived blame from the County to the driver in its entirety is also wrong...once again, there has to be SOME personal responsibility for him being where he should not have been. It is irrelevant who there are suing, to be honest, because if he was NOT in the road, this wouldn't have happened. Simple as that...
