The majority thought the exotic dancer in the Duke case was "gang raped" until DNA evidence, which the Durham NC D.A. had been purposely withholding from the defense, proved otherwise.

This case has all the ingredients of a classic "he said, she said," and it is possible this is another false accusations case. Did the law enforcement officials thoroughly investigate both parties, or just the accused in this case? If they didn't investigate the accuser as well, why not? Isn't anyone familiar with the old Ronald Reagan line "Trust, but verify" any more?

Hey, look what I found when I was searching court documents for information about this case. It looks as if Jennifer Hughey was out for some money before all of this started. Check out Civil Action File No. 2007-CV-129727. Very enlightening information.

Merry Christmas to all! May Officer Gavin have success in beating the setup, and may Jennifer Hughey have success with beating alcohol and drug addiction! And in 2009 may we have people who don't get themselves drunk, do something they regret, and then blame someone else for their actions. And may 2009 be free of frivolous lawsuits against police departments and apartment complexes.

Folks, listen up for a second. Gavin was accused of rape back in August of 2006 by this woman Jennifer Hughey. He turned in a copy of the sex tape to internal affairs soon after Jennifer made her accusation. If any police officer walked up to Gavin and questioned him about the accusation, Gavin would answer every question they had; Gavin even showed some police officers the sex tape in his apartment so they knew he was telling the truth. But NO police officer would ever admit under oath that they were shown the tape beforehand because they don't want anything to do with Gavin's setup.
But once Gavin got arrested 8 months later for this false accusation, some police officers were helping him to investigate Jennifer Hughey's past. We found out she has a felony DUI from Arizona in the 90s, and we also found out some more accusations she made when she lived in Arizona. But we won't disclose everything that was found out about her because it will come out during the trial. But trust me folks, Jennifer Hughey's past is already known all throughout the police department.
We also know about the lawsuit Jennifer Hughey filed against Gavin, the police department and the apartment complex they both lived in. Jennifer was trying to get $750,000 dollars from the apartment complex simply because Gavin lived there. This case is garbage and the prosecution knows it. Gavin just got swept in to the whole APD corruption stigma with the Katherine Johnston shooting.

As a person who used to work at the apartment complex whom Jennifer Hughey is suing, I can tell you that this lady is NUTS!! She claims to suffer from bipolar disorder, yet she also claims to be an alcoholic. What the hell is she doing drinking alcohol if she's bipolar? There are at least 6 of us who are going to testify that she NEVER complained about Officer Gavin harrassing her until she claimed he turned into Peter Pan and flew through her 3rd story window. That turned out to be a delusion anyway. She's nuts if she thinks the apartment complex is going to give her any money.

I don't know her but I do know Mr Arrington pretty well. He's fair and loves the city of Atlanta with all his heart. I posted this story on some other forums. These DA's tend to get very arrogant. This was a $100.00 fine. Mr Howard has done a pretty good job so far. But I'll bet he told her not to pay it. The DA's tend to think they are above the law. Judge Arrington just let him know he wasn't. Good job Your Honor. I love this story.Thanks for posting it.

The way I see it, if one doesn't know both the accused and the accuser, it is impossible to determine the accuracy of either party.

I do know two things; that there are cops who can't be trusted with the authority their badges have given them, and that there are also false accusations of sex crimes, be it rape, child sex abuse, or variations thereof, against police officers. Whether this officer is guilty or not will probably be decided by a jury. Furthermore, I believe he should receive the same Constitutional protections as every other citizen accused of a crime is entitled to under the law.

Personally, I think the subject of false accusations and wrongful convictions -- the first often leads to the second -- should be discussed and debated constantly, even after an individual case has been closed. The number of false accusations has gone up a great deal over the past ten years, mostly because false accusers are almost never held criminally accountable.

I think that's an outrage and a disgrace, because a false accuser who gets away with destroying someone's life simply because she is pissed off at the accused for whatever reason is also a threat to the community. If she got away with it once, there is really nothing to stop her from doing it again to the next person she gets ticked off at. Rather like a career CRIMINAL, if one stops to think about it.

Also, a malicious false accuser damages the credibility of REAL victims of any kind of sex crime, which is another reason why they need to be prosecuted. There are two possible ways that could be done, by charging a person who has been PROVEN to be a false accuser with filing a false police report or with perjury if the accuser is caught lying on the witness stand in court. If more proven false accusers were prosecuted for felonies themselves, I believe we'd all see a serious reduction in the number of false accusations cases in a very short time.

I agree. This guy could have been framed. LEO's get accused of things all the time. Most are innocent ,some are true. He needs to have the same protection under the law as any of us.

People who make false accusations should be subject to the same punishment the person they falsely accused was facing. Now, I'm not saying if someone is found not guilty, the person making the accusation should be jailed. Just because you're found not guilty doesn't mean the people who accused you of a crime were lying. But if it can be shown the person making the accusation, citizen, cop, or DA was lying to frame the person, they should get the same sentence they put that person in jeopardy of receiving.

At this point, I would settle for PROVEN liars to be prosecuted for either making a false police report or perjury, and sentenced as the guidelines on those offenses currently state.

It may not be as much time as what you and Sage were suggesting, but I think it's better than nothing. Right now, nothing is being done about these malicious false accusers, and I'd rather have half a loaf than none.

I agree, and from what I understand from reading another post, Officer Gavin may have been acquitted last year.

Nevertheless, I think the issue of deliberate and malicious false accusations (NOT the same as honest mistakes) and the devastating effect they have on those accused is one that needs to be talked about continuously. Because as the real-life cases of false accusations clearly demonstrate, they still occur far more often than some feel comfortable admitting. These cases also show that the nightmare of a deliberate and malicious FALSE accusation can indeed happen to anyone, be it a police officer or an average citizen.

It has now been confirmed that Jennifer Hughey lied about being raped and kidnapped in Italy in 1986. She was NEVER in Italy during the time she said she was based on travel documents that have been obtained. This means she's committed perjury!!!! She will be asked about this during her civil trial and she'll have nowhere to run and no excuses to use. She will be brought up on perjury charges without a doubt, punishable by up to 10 years in prison!! She must've thought no one would investigate her past false rape allegations.

It is often very difficult for a person to hire a private investigator to check out the accuser's past, usually because all of their money is tied up with getting a good lawyer to handle their case.

When it comes to deliberate and malicious false accusations, the accused usually needs a good lawyer experienced in false allegations cases AND a good private investigator too. If the accused doesn't have the money for either a lawyer OR an investigator, the odds for a wrongful conviction go up significantly. Wrongful convictions happen to many innocent people simply because they didn't have the funds to hire good legal representation. Too often the lawyers who are appointed to represent the accused have neither the skill nor the spirit to defend their clients effectively. And prosecutors like it that way; it helps them get more convictions. Whether a person is really innocent or guilty is something they couldn't care LESS about.
