1 Two Barnhardt residents are fed up with the fence around the Barnhardt Circle ballfields. A lawsuit against the city of Fort Oglethorpe, Catoosa County Board of Education, and Lakeview Fort Oglethorpe Recreation Association was filed in the Catoosa County Superior Court on Oct. 15. The plaintiffs are Ed and Radonna Parrish. City manager Ron Goulart said Fort Oglethorpe and the Board of Education both own parts of the ballfields, and the recreation association organizes teams and events on the fields. The plaintiffs have sued the city for “substantially and irreparably” harming the public and themselves for allowing the ballfields fenced in with the gates kept locked. The lawsuit, filed on behalf of the Parrishs by Weldon Law Firm in Ringgold, says the fence is a violation of the William and C.W. Stephenson deed from 1950. It says the property was given to Fort Oglethorpe “to be used for the purposes of public schools, and/or parks or playgrounds and other public purposes, and for no other purpose.” The 14-page lawsuit says locking the fence up keeps the public out and violates the deed. The fence was put up in May 1974. “It’s a little late to be raising these issues,” Goulart said. He said the fences are there to keep out vandals and to protect the people watching the games. Goulart wondered how players will know they hit a homerun if there’s not a fence. “We love to let people use the ballfields,” he said. The plaintiffs are asking for the court to rule that the fence be removed. They also want the defendants to pay their lawyer fees. Each defendant has 30 days to respond to the lawsuit. Neither of the plaintiffs nor their lawyer could be reached for comment. This is absolutely hilarious. What is next, removal of the scoreboard,the bases,bleachers...... and then, the kids?! My children and grandchildren have all played at those ballfields. My thought is let the fences stay and let's eject Red and Adonna Parrish from the game! |

1 Blah! Blah! Blah! is all you hear over there on Barnhardt Circle. I personally think they need extra fencing to contain all those nuts that live over there in the hysterical district. |

1 First of all you should listen to all the evidences before you start making judgement. I personally know some of the people that live on Barnhardt Circle and they are good christian people. |

1 Peace first of all you need to learn how to spell it's evidence not evidences. Then you need to learn how to read, I didn't read on here where it said a christian couldn't be crazy. Someone posted on here that they need extra fences for some of those people that live in that area and I have to agree no fence around a ballfield is crazy. What would you do if a dog came into the crowd and attacked people or scraped in your snack? What would you do if a car couldn't stop or the brakes went out while pulling into parking lot? What would you do if someone was sitting in the car and had a stroke and car just plunged into the crowd? What would you do if a car drove by and the tire or somthing fail off and rolled in the large crowd and hit and hurt several people. Shall I go on all day?......... No I shouldn't! I don't want to waste my valuable time on ignorance! No fence you say what would happen then? The City would be sued for negligence! DUH If I was the city administration the only thing I would offer to pay for is Professional Counseling for the Plantiffs it would make the world a better place. |
