Of all the interviews I have heard of, always it has been a viet National who seems to be conducting the interviews for prospective Visa applicants. Numerous times the request is denied with little evidence of fraud on the part of the applicant. It is the whim or ill-thought decision of the interviewer who denies the applicant. I dont discount the fact there is inherent bias on the interviewer's part and indeed many Viets look down on those who wish to emigrate to the US whether as a wife or political beliefs. The Embassy/consulates take a hard view of those trying to come to the US and look for anything to deny the visa. Even my wife's sister tried to gain a 30 day tourist visa to visit us in the US and she was denied. It is a difficult process to get a Visa. I wouldnt be surprised the Viet interpreter is connected to the Vn gov also.<quoted text>
That is the truth. If the Visa was denied (my wife and daughter's were denied for 5 years...we still don't have them( It is always a Viet National worker. See, the Embassy receives a lump sum budget. So, they hire cheap labor -$100/month Viet's to do the work and the Americans get nice fat checks, nice cars, nice French Villas in Sai Gon...yes, I still call it Sai Gon. They live like kings and queens.

Why was my wife and daughter refused? They didn't speak English to the satisfaction of the "officer" It didn't matter that we had 1100 pieces of evidence including pictures and a 2 hour professional video of our formal Buddhist wedding, hotel, restaurant, car rentals, airline, bus, train tickets, etc. Over the 10 years I've been going to Vietnam, I knew my wife for 2 years before marriage. Didn't matter, the "officer" didn't give a damn. Because He can't go to the US, he was making damned sure others couldn't too. I've paid out over $62,000 in fees, lawyers, advisors, and trips to be with my family. It sucks.

Hi, Mister Kurt,
I'm glad to hear you again and knowing your appeal start rolling..
This is my personal suggestions into your situation regarded to legal process for your case:
1/You don't have to hire two immigration lawyers from each end of the world in your case. Due to your own convenience, I suggest you start everything from USA. That way would save you a lot of money for future, also a lot of convenience within your reach. Your case was denied solely by US side, then you start working at US side, that's it.
2/When you have summon to show up(in court)in front of Immigration board, if you have lawyer, it wouldn't be no problem. They(a team of at least 3 staffs/officials of Immigration Board) would ask you FEWER THAN 4 questions then make their decision, case closed and you's O.K, just simple like that. Actually, if you're not busy and to save money, you can start all processes without lawyer. Just keep all of proofs, evidences to prove your bona fide relationship, you still win the case with the rate of more than 85%. With lawyer this success rate was not less than 98%.
3/To my knowledge, and be frank:
-Most of staffs in VN(themselves are either immigrants of US or local Vietnamese) who work for US are bias, ignorant and arrogant. In fact, most are just a bunch of idiots.
-I bet you when you find out your case after O.K, US Immigration Office would stick up for their messy work, either by blaming the incompetence of their staffs or just simple your case was interviewed by "new/replacement" worker of their.
4/ Anyway, good luck to you. Myself I believe you and your family WILL BE REUNITED, trust me and looking forward your result...
To you of my best wish! Damn the ignorant, careless people.
Myself, wife and kids, we fly to Vietnam almost every year and I have my own home in HochiMinh City. I wish we could see you there soon! Take care Bud!
Yeah man. Those others don't know what they are missing. It is great. Nha Trang is like paradise. You have fun there next time. I think we have our Visas, in the next couple weeks. I'll wait for my daughter to finish the school year, then go over for fun, relaxation and then home to OUR home in the US. We have an apartment in Nha Trang too. Have a great time!

It's been 5 years, and they denied our applications because, get this, they had all the papers already approved, then put them away for a year. Now they say we are being denied because the papers are all too old, they are no longer within the necessary dates. I repeat, they had them for a year and allowed them to expire. New, we start again, new medical exams, new interviews, Why? Could it be that the staff at the Consulate Office in Sai Gon are lazy and can not get their work done on time, so they blame the applicants? It seems strange to penalize the applicants for the mistakes of the Consulate Gneral's Office workers.

It's difficult to tell a fake marriage from genuine one. We all know that it's a trade to pretend to wed a local person (boy or girl) in a third world country so that the person can get a permanent resident status in the US, Australia and Canada. That is the reason why they are tough with applicants. A fake marriage can fetch as much as 100,000 USD or even more for the one who has American citizenship and agrees to marry the person who wants to get into the US.

As for Vietnam, if there is a sponsor who accepts to take care of the Viet person in a foreign soil they will be glad to issue an exit visa for that person.

To issue an entry visa for a person is a different thing. One must qualify.

The person who has the power to refuse the entry visa to the US can't be a locally hired Vietnamese working at the US consulate. He must be from the States department with the rank of a consul at least.

That the visa consul is of Vietnamese descent is quite possible and this person can create trouble cause delay or even cancel the application. However, the consul makes the same salary as any other white consul at the embassy. No budget problem here.

You can be as honest as an angel but if you don't have luck in life you won't be able to do much. Luck is what you need.Good luck
