COP PLEADS GUILTY TO POSSESSION OF OVER $91K IN STOLEN GOODS

A police officer has entered guilty pleas in two theft-related cases.

[ Another police crime committed UNDER THE COLOR OF LAW ]

Officer Paul James Kezar, 38, was accused of possessing more than $91,545 worth of stolen items in Pennington and Marshall counties.

Officer Kezar pled guilty in County District Court to a felony charge of receiving stolen property. He entered an Alford plea to a felony charge of theft noting there was overwhelming evidence that may have led to his conviction.

DA Rogalla said,“You knew or should have known that those items were was stolen.”

“Yes, I agree to that,” Kezar replied.


Kezar then officially entered a guilty plea and an Alford plea to the charges of felony theft.

Judge Aandal advised him that it would be unlikely for the court to withdraw the Alford plea if Kezar later made the claim that he wasn’t guilty. Aandal also told him if he made any denials in letters to the editor in the future, Kezar could be charged with perjury.

[ Another bad cop crime committed UNDER THE COLOR OF LAW ]

A police officer was sentenced Thursday on charges of making false statements to an FBI agent regarding the sale of a short-barreled assault rifle to a Polk County deputy.

Officer Justin Matthew Dawson, who resigned after charges were filed, was sentenced to one year and will have to surrender his police certification within 30 days.

He earlier waived his right to an indictment in U.S. District Court in Rome and PLEADED GUILTY TO A FELONY FALSE STATEMENT CHARGE IN MARCH.

According to information presented in court:

On April 1, 2009, Dawson sold a Rock River Arms LAR-15 with a 12-inch barrel to former Polk County Sheriff’s deputy Michael Robinson, who later sold it to an undercover FBI agent. Dawson learned of the federal investigation and made contact with agents April 13.

At that time, Dawson told the FBI he owned and later sold Robinson components of the firearm, which is not illegal.

However, federal authorities said other testimony showed Dawson had possessed the assembled weapon in its entirety without reporting it to the proper authorities and sold the entire weapon to Robinson — an illegal transaction.

Robinson still awaits trial on firearms charges related to the sale of the weapon and fraud charges.

He faces as much as five years in prison, a $250,000 fine and three years of supervised release.

A Salinas teacher suspected of molesting a male student was arrested again Tuesday for allegedly molesting two other boys.

A 15-year-old boy and a 20-year-old former student told police they were molested by Manuel Rivera, 66, Salinas police Sgt. Don Cline said.

Rivera, a Spanish teacher at Everett Alvarez High School, was arrested Nov. 1 after a 16-year-old boy reported being molested by Rivera. The boy stayed after school to get help with schoolwork when the alleged incident occurred, police said.

Rivera posted bail and was released from Monterey County Jail. After news coverage of the teacher's arrest, the other boys came forward, police said.

Rivera was arrested Tuesday at his home and lodged into county jail with bail set at $1.8 million.

Police are recommending that he be charged with 18 counts of committing a lewd act upon a child and one count of annoying a child.

• They didn’t use stun grenades ( regular readers are aware that courts are now ruling that the use of bombs by police are actually a excessive force criminal assault against the populace in such cases.

For example, the NYPD has completely stopped using them after getting sued and, oh yeah, killing people with stun grenades..]

In February, I wrote the following about a drug raid in Missouri:

SWAT team breaks into home, fires seven rounds at family’s pit bull and corgi (?!) as a seven-year-old looks on.

They found a “small amount” of marijuana, enough for a misdemeanor charge. The parents were then charged with child endangerment.

So smoking pot =“child endangerment.” Storming a home with guns, then firing bullets into the family pets as a child looks on = necessary police procedures to ensure everyone’s safety.

It’s horrifying, but I’d urge you to watch it, and to send it to the drug warriors in your life.

This is the blunt-end result of all the war imagery and militaristic rhetoric politicians have been spewing for the last 30 years—cops dressed like soldiers, barreling through the front door middle of the night, slaughtering the family pets, filling the house with bullets in the presence of children, then having the audacity to charge the parents with endangering their own kid.

There are 100-150 of these raids every day in America, the vast, vast majority like this one, to serve a warrant for a consensual crime.

But Jonathan Whitworth won’t be smoking that pot they found in his possession.

So I guess this mission was a success.

I’ve exchanged emails with the mother of the family, who was in the home at the time of the raid. I’m waiting on her permission to publish her account of what happened.

Police and Taser Abuse Under The Color Of Law

Monday, May 10, 2010

TASERS, IN USE by police departments for more than a decade, are meant to be a weapon of last resort against dangerous suspects who pose a serious threat to police officers or a risk of flight. They are also supposed to subdue suspects, not kill them. But in too many cases, including at least one recent incident in Arlington County, suspects have died after being Tasered.

AND THERE IS DISTURBING EVIDENCE NATIONWIDE THAT POLICE OFFICERS ARE USING THEM WHEN LESS DRASTIC, AND LESS POTENTIALLY DEADLY, MEASURES WOULD SUFFICE.

Police routinely INSIST they fire stun guns only in dire situations, but eyewitnesses materialize to contradict them.

For an object lesson in Taser misuse -- and a clue as to how itchy-fingered police officers can be -- look no farther than the outfield of Citizens Bank Park in Philadelphia, where the Phillies hosted the Cardinals last Monday before 45,000 witnesses.

What they saw was a scrawny, unarmed teenager who jumped on the field and ran figure eights around huffing and puffing security and police officers. After a few seconds of this, a Philadelphia police officer took aim with his Taser and dropped the youth in pop-fly territory. As he lay face down on the grass,

THE CROWD BOOED THE POLICE LUSTILY -- AND WITH GOOD REASON.

Fans who disrupt games should be prosecuted and fined and possibly face jail time; they should not be Tasered unless they appear violent or pose a threat more serious than disrupting a game.

Still, the Philadelphia police commissioner, Charles Ramsey, who reviewed video of the incident, said his officer had acted within department guidelines.

THAT'S THE PROBLEM.

While Tasers have been useful in protecting officers from dangerous and out-of-control suspects, in too many police agencies THE POLICY ON USING THEM IS SO LOOSELY DEFINED THAT OFFICERS CAN FIRE THE WEAPONS MORE OR LESS WHEN THEY FEEL LIKE IT.

Amnesty International, which has conducted detailed studies of the use of Taser guns, concluded that in about 90 PERCENT OF CASES INVOLVING TASERS, THE WEAPONS WERE USED ON UNARMED SUSPECTS.

In many of those cases, the suspects may have been disrespectful, strange or defiant but seemed to pose little danger to themselves, others or police.

Most disturbingly, Amnesty found THAT 334 PEOPLE HAD DIED AFTER BEING TASERED BETWEEN 2001 AND 2008. AND WHILE MOST OF THE DEATHS WERE ATTRIBUTED TO DRUG AND ALCOHOL INTOXICATION, MEDICAL EXAMINERS AND CORONERS FOUND THAT TASER SHOCKS CAUSED OR MAY HAVE CONTRIBUTED TO AT LEAST 50 DEATHS IN THAT PERIOD.

Based on that, and numerous studies suggesting that Tasers can have lethal effects on some people, Amnesty has called for a halt to the use of stun guns.

Unsurprisingly, Taser International, a 17-year-old often sued firm based in Arizona, has disputed the studies and Amnesty's conclusions.

BUT IF POLICE AND THE WEAPONS' MANUFACTURERS WANT TO AVOID A PUBLIC BACKLASH,

they'd be wise to tighten rules to preclude using the weapons on suspects who may be annoying or disruptive but ultimately pose no threat of harm.

POLICE DETECTIVE INDICTED BY FEDS ON EXTORTION CHARGES FOR TAKING MONEY FROM SUSPECTS TO AVOID BAIL OR REDUCE CHARGES

A police officer is due to appear in federal court Monday afternoon on extortion charges.
The U.S. Attorney's Office just unsealed the indictment .

At the time of the charged crimes, Officer Robert Ford was a homicide investigator with the Police Department.

The indictment states that Ford accepted money from several suspects in return for helping them either get out on bond or receive lesser sentences, by telling prosecutors that they provided information in homicide investigations. The indictment says suspects never assisted in the investigation of homicides.

The Ford investigation dates back to March 2003, and according to the indictment, the CONSPIRACY continued through May 2007.

On February 19, 2010, FBI agents interviewed Ford.
FORD NOW FACES FIVE COUNTS, WHICH INCLUDE ONE COUNT OF CONSPIRACY TO COMMIT EXTORTION UNDER COLOR OF OFFICIAL RIGHT, THREE COUNTS OF EXTORTION UNDER COLOR OF OFFICIAL RIGHT AND ONE COUNT OF FALSE STATEMENT.

Ford was an investigator on several high profile cases, including the July 1997 rape and murder of Michelle Moore-Bosko .

Ford founded RGF Investigations , a private investigative service. According to the company website, Ford investigated more than 200 murders while in the homicide division.

A former North Henderson High School teacher accused of soliciting sex from an underage girl over the Internet will plead guilty Monday.

David Frank Pace reached a plea agreement, according to federal court records filed earlier this week. The details of the plea agreement were not made public. Pace was charged with one count coercion or enticement.

Investigators in Buncombe and Guilford counties charged Pace in July with soliciting sex from a child over the Internet after chatting with investigators posing as underage girls.

Authorities said he's also charged with similar crimes in South Carolina. The federal grand jury indicted Pace in October.

Pace had taught at North Henderson since 1993. He resigned and surrendered his teaching license in August.

A former teacher at an eastern Maine school has been sentenced to 30 days in jail for having a sexual relationship with a 13-year-old boy.

Thirty-one-year-old Tina Mason of East Machias was sentenced Friday in Washington County Superior Court. She was also given two suspended sentences of 11 months in jail.

Prosecutors say Mason, her husband and their two children were friends with the victim's family.

After the activity came to light, she resigned her teaching position at Lubec Consolidated School. The victim did not attend the school.

Besides going to jail, Mason has to give up her teaching certification and will register as a sex offender for 10 years.

A federal judge sentenced Wenatchee resident Nestor Mora to 10 years in prison Wednesday for receiving child pornography via the Internet.
By sentencing Mora, 30, to 10 years, the judge honored a plea deal reached in September. As part of the deal, prosecutors dropped a count of possessing child pornography.

The minimum sentence for receiving child pornography is five years in prison; the maximum is 20 years. For possessing child pornography, there is no minimum sentence, and the maximum is 10 years in prison.
“We chose to go with the one that at least assured us of a five-year sentence,” said First Assistant U.S. Attorney Tom Rice when the deal was reached.

The 10-year sentence will run consecutively to the 17-month sentence Mora received in Chelan County Superior Court in April on convictions of child rape, child molestation and luring, the judge ruled Wednesday. In Chelan County Superior Court, Mora admitted having oral sex with a 14-year-old boy at his home in January.

Embattled Nye County District Attorney Robert Beckett was arrested Wednesday morning on fraud and embezzlement charges in connection with a bank account his office managed for more than 13 years.

"This is in reference to the bad check fund," said Nye County Sheriff Tony DeMeo, whose officers in April seized a computer and other items related to the Nevada State Bank account.

Beckett, who was arrested without incident, has said the investigation was the result of political enemies.

"They don't have their facts straight," Beckett said Wednesday evening. "They misinterpreted the law, and then they took exceedingly inappropriate action."

Beckett, who was arrested in a bizarre DUI incident in California more than a year ago, seeks his fifth term and is in a heated race that includes Ron Kent, his former chief civil deputy; disgraced former Clark County Family Court Judge Nicholas Del Vecchio; and Brian Kunzi, a senior deputy attorney general.

Beckett was released by midafternoon on his own recognizance. Because he is the district attorney, a special prosecutor will be named to handle the case, DeMeo said.

DeMeo denied the heated election was behind the arrest.

"This wasn't motivated by politics," he said.

Beckett has been charged with more than 40 counts, including 20 counts of fraudulent appropriation of property, 20 counts of misconduct of a public officer, one count of malfeasance of office and one count of embezzlement.

DeMeo said he was unsure how much money is involved because the account "was rapidly depleted" and had about $15,000 left.

"One thing that was interesting is we found evidence a car payment was made for a family friend," DeMeo said.

"That's not true," Beckett said. "I never used that account to pay off anything for family or friends."

Beckett said the funds were given to charities, but DeMeo said it doesn't appear the money was used for "altruism."

The bad check fund had never been audited in 13 years, Beckett said.

DeMeo was unsure whether that was accurate, but he said Nevada law spells out that such accounts must be audited by county treasurers.

Beckett reportedly had skipped several meetings requested by Nye County Treasurer Gary Budahl and Dan McArthur, the county's independent auditor.

The bad check fund receives its money from people charged with writing bad checks. The money is supposed to be used to reimburse victims of bad checks. Bad-check writers also must pay fees on top of their reimbursements.

DeMeo said he did not know how many people were fully reimbursed.

Beckett last week said the fund was being phased out because "people aren't writing bad checks anymore."

He said he would call a news conference "once I sort through this mess. Until then, I can't say anything else."

A police officer was indicted with SEVERAL FELONY CHARGES Monday after a videotaped traffic stop showed him beating a motorist repeatedly with a baton in March.

Streamwood Officer James Mandarino, 41, was indicted WITH THREE COUNTS EACH OF AGGRAVATED BATTERY AND OFFICIAL MISCONDUCT, County State’s Attorney’s office spokesman Andy Conklin said. He will appear for arraignment on May 27.

Mandarino surrendered to authorities on April 15 and was ordered held on $50,000 bond.

Mandarino beat a motorist repeatedly with his baton during a traffic stop, leaving the man with a CONCUSSION, SEVEN STITCHES TO HIS EAR AND MULTIPLE CONTUSIONS, according to a release from the state's attorney's office.

A PASSENGER IN THE VEHICLE WAS TASERED TWICE during the encounter, which was captured on videotape, the release said.

THE VIDEOTAPE, SHOT BY MANDARINO’S SQUAD CAR DASH CAMERA, SHOWED NO EVIDENCE THAT THE MOTORIST OR PASSENGER EVER RESISTED ARREST OR PRESENTED ANY PHYSICAL THREAT TO THE OFFICER, PROSECUTORS SAID DURING BOND PROCEEDINGS.

The incident happened on March 28 about 3:45 a.m. near Schaumburg Road and East Avenue in Streamwood, the release said. Mandarino, a 15-year veteran of the department, was working the overnight shift when he saw the motorist's vehicle and began a pursuit.

Mandarino pursued the vehicle a short distance before the driver parked the car in the driveway of his home, the release said. Mandarino exited his squad car with his weapon drawn pointing his gun at the motorist and his passenger.

Prosecutors say Mandarino raised his metal baton. And then, as seen in the videotape recorded from the officer's patrol car, Mandarino whacked Ronald Bell 15 TIMES ON THE BACK, UPPER BODY AND HEAD.

Ronald Bell suffered a concussion, seven stitches to his ear and multiple bruises and scrapes.

An independent investigation by State Police was requested on the same day, according to a release from police.

State Police turned the matter over to the state's attorney's office special prosecution department, the release said.
