It depends on the cicrumstances at the time of the shooting. Nothing prior has any merit, It makes no difference even if there had been prior threats on his life It would not matter That is the law. Anyone who has taken the CCW classes will tell you the classes Basicaly teach you exactly when you can shoot and when you cannot.
So it would depend completely on what happened. If he just walked out and shot Staker dead, Then Yes he would have been charged.

Not if Staker had drawn a weapon FIRST and pointed it in Holsinger's face.
That would be self defense, same as it was when this shooting occurred.

You don't have to pull a gun to be an aggressor..if you provoke an incident your an aggressor..Harassing and not leaving and trespassing on a mans property is not a peaceful repossession which wasn't done Ohio has laws that protect people like Holsinger and those laws were broken Steve must've not knew his rights had he called the cops the stakers would've had to leave they were commiting a breach of peace which according to the state of ohio would end the repossession at that time and they could be forced to handle it in small claims court.
