Broward County condo wants to stop resident's use of Segway
Stanley Blumenthal, 83, rides his two-wheeled, self-balancing Segway to visit his girlfriend, shop at Publix, buy stamps at the post office and go to his doctor's office.

This is not a legitimate case of looking out for other resident's best interests and has nothing to do with safety. It DOES have EVERYTHING to do with overusing one's power in a board position to make themselves feel more powerful. This is unfortunately very, very common here in South Florida. There is nothing wrong with Segway use. In fact, it's a great option for getting around rather than using a car. Since the Segway was already owned and being used, if the board puts a new rule into motion, he can absolutely fight in court stating that the Segway was there and owner before the new rule. There was nothing about it prior. The board members of associations down here just blow me away. They're supposed to be intelligent and reasonable people and instead they are insecure, ugly personalities only seeking to boost their egoes. Nothing to do with the communities best interests. THIS IS REALITY. It is widespread down here. I have never seen so many bundles of stupid, foolish people who actually end up screwing communities up. This comes from a lack of decent people living in the area these days. Those people have been pushed out by this garbage. Thus, you see South Florida sliding downhill rapidly.

I live in Ft Lauderdale (condo) and have been using one for many years since they first were available
my thoughts would be that as the segway is similar to a bicycle and that the segway is not a vehicle under florida law, I can't see the association prohibiting its use, although they may be able to stop him riding through the building (similar to them probably being able to prohibit owners from riding a bicycle in the hall). a segway is not a vehicle as defined under florida statutes section three sixteen .003 - eighty three ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICE.--Any self-balancing, two-nontandem-wheeled device, designed to transport only one person, with an electric propulsion system with average power of 750 watts (1 horsepower), the maximum speed of which, on a paved level surface when powered solely by such a propulsion system while being ridden by an operator who weighs 170 pounds, is less than 20 miles per hour. Electric personal assistive mobility devices are not vehicles as defined in this section. additionally if the rider has any kind of mobility issue such as limited walking ability, he or she could use such a device under the ADA also see http://www.draft.org/draft3/ you are also correct that segway use is permissable under florida statutes section three sixteen.2068 Electric personal assistive mobility devices; regulations.-- (1) An electric personal assistive mobility device, as defined in s. 316.003, may be operated: (a) On a road or street where the posted speed limit is 25 miles per hour or less. (d) At an intersection, to cross a road or street even if the road or street has a posted speed limit of more than 25 miles per hour. (e) On a sidewalk, if the person operating the device yields the right-of-way to pedestrians and gives an audible signal before overtaking and passing a pedestrian. (2) A valid driver's license is not a prerequisite to operating an electric personal assistive mobility device. (3) Electric personal assistive mobility devices need not be registered and insured in accordance with s. 320.02. (4) A person who is under the age of 16 years may not operate, ride, or otherwise be propelled on an electric personal assistive mobility device unless the person wears a bicycle helmet that is properly fitted, that is fastened securely upon his or her head by a strap, and that meets the standards of the American National Standards Institute (ANSI Z Bicycle Helmet Standards), the standards of the Snell Memorial Foundation (1984 Standard for Protective Headgear for Use in Bicycling), or any other nationally recognized standards for bicycle helmets which are adopted by the department. (5) A county or municipality may prohibit the operation of electric personal assistive mobility devices on any road, street, or bicycle path under its jurisdiction if the governing body of the county or municipality determines that such a prohibition is necessary in the interest of safety. (6) The Department of Transportation may prohibit the operation of electric personal assistive mobility devices on any road under its jurisdiction if it determines that such a prohibition is necessary in the interest of safety. |
