The Law, as written in The General Laws of Massachusetts, Chapter 272 Section 31, must be
changed to allow the freedom of parents to choose from infancy, to let daughters run top-free anywhere their sons do. A generation of children then will be born, who as adults, show true gender respect, tolerance and equality. That true gender respect, tolerance and equality could be fostered by this superficial display of freedom seems silly.. |

female breasts are sometimes beautiful, but always natural. it is crazy to turn women into criminals when men run around topless. there would be a lot fewer perverts in berkshire county if kids grew up seeing boobs the way they see arms and legs. good luck in your cause. we got freedom for women down here in south florida, the da refuses to prosecute women for being topless on beaches.

On June 15 when I was before the Parks Commission I met someone who directed me in the direction of applying for a Public Policy Question (PPQ). This person put me in contact with an attorney at the AGs Office and gave me papers to get me started. I began collecting signatures on June 19 using this question:
“Shall the state representative from this district be instructed to support legislation which would amend the state’s definition of nudity, so that no part of the female breast is included and so that females of any age may be unclothed from the waist up in public, anywhere males may be(unclothed from the waist up in public), including in print and on film?” I have until July 7 to obtain the required 200 signatures plus 2/5 more. I have the 200, now I am trying for 2/5 more. I am learning a lot being out there asking for signatures. For, I heard :“Fair is fair”,“It’s good to see someone out here standing up for what they believe in”,“I don’t know why we make such a big deal of it here”. Against, I heard:“Oh, no! My breasts are prizes!”,“I have a young daughter I don’t want her seeing THAT!”. Since I can’t argue outside for risk of losing the privilege of asking the Public for signatures, I would like to respond here to some of the against arguments I heard. To the person who said:“My breasts are prizes” I say “No equality in pay then” I don’t think it is possible to reach equality in pay while still holding onto the attitude that one gender is more sacred than the other. It seems as if females use their breasts as bargaining chips. When someone says “My breasts are prizes” it sounds as if they are saying “My chest may be seen if one puts a ring on my finger or buys me a big house.” To the young father who said “I have a young daughter, I don’t want her seeing THAT!” I ask “But it’s ok if she sees yours? Do you want your daughter to believe that having a female chest is bad? Do you want her to be ashamed of her body? Why is it ok for your daughter to touch your chest when you are holding her? Can’t the male chest also be stimulated by touch?” I believe this Law was written for one reason, to deter adultery. By the way, there is also an active Law against adultery providing for a penalty of up to 3 years in prison, 2 years in jail or a fine of up to $500.00. This law is no longer enforced, though it IS still active- General Laws of Massachusetts Chapter 272 Section 14. But the Law preventing females from equal access to sunshine IS STRICTLY ENFORCED. The reason? While it I believe it started innocently enough with the idea that covering the female breast would protect females and deter adultery, in this day and age, with our large Police Force , the main reason it is enforced is to protect the interests of the porn industry. By encouraging society to keep the sight of the female chest under lock and key, pornographers are able to condition the public into viewing the female chest as objects of sexual fantasy and taboo. |

I would like to respond to some other arguments against I heard:
To those who said men may get aroused I reply, men are aroused when seeing women and girls dressed in short shorts, miniskirts, heels and low cut shirts. I have seen women more provacative fully clothed that I am only clothed from the waist down. To those who said it isn't proper for females to be unclothed from the waist up on Main Street I reply it isn't proper for males to be unclothed from the waist up on Main Street. I would like to see the definition of nudity amended so that both sexes may enjoy equal access to sunshine. I suggest that Municipalities write ordinances requiring all people to be fully clothed from the neck down in Business Districts. To those who said there will be an increase in acts of violence against females I reply females should have the right to enjoy the sunshine the same way as males. We all take risks when it comes to safety. Because someone else is afraid of an act of violence I should not be prevented from equal access to sunshine. To those females who said I don't want to see womens breasts. I say I don't want to see yours either I just want the sun on mine. |

To those females who said I don't want my boyfriend or husband seeing other womens breasts. I don't want other women seeing my boyfriends chest but men are not going to give up an esential liberty , the right to sun on their back and comfort while outdoors. It is sad that females will continue to uphold a law which denies other females essential liberty and pursuit of happiness in what seems is only a desperate and possibly futile attempt to prevent the object of their desire from straying.
I wonder if this law was not written to protect females from acts of violence but to protect other females from the feeling of jealousy in the extreme. |

Judged: 2 To those who said children should not be exposed to womens breasts. I say by continuing to shield children from the sight of womens breasts in public, while forcing the sight of mens chests on children, children will continue to be conditioned to view womens chests as objects of sexual fantasy and taboo and continue to expect that males will receive more rights than females. |

Judged: 1 1 On August 15, 2010, Mr. Levenson writes: "Katherine Gundelfinger has collected the requisite 200 signatures to place a local question on the November ballot sure to test public mores: Should the state’s definition of nudity be changed to allow women to sunbathe topless?" Mr. Levenson, why didn't you type the question as it appears on the PPQ Petition forms? The question as you paraphrased it is misleading to readers. Also your statement: "The nonbinding question, if approved by voters in the district where she lives, would not immediately transform Pittsfield’s modest swimming holes into nude beaches." is contrary to the question. If the states definiton of nudity is amended, approving this legislation would never create "nude" beaches in Mass. |
