Judge ponders whether to release documents in Paradise excessiv...
A Butte County judge Monday agreed to examine additional police documents before ruling whether to turn any of them over to a Paradise man who claims that arresting officers broke his arm.

You can bet the judge will release the documments to Mr Funks lawyer, as the Judge knows the FBI is in town. The window is getting small for these rebel cops!

The judge should release any information to this guys lawyer reguardless of what the FBI fines. I think cops are becoming increasingly hostile towards the puplic. They are not much better (if at all) than some of the thugs they arrest.
They need to change their motto form "To protect and serve" to "Your dead meat punk" |

There is a solution to get police and deputy records...It's called the Pithcess Motion or Evidence code 1043 et seq. Also referred to as the "Brady Motion." I used this in Plumas Co. against a rouge cop this last year.

But that's what was used in both cases, Funk and Schumacher. In your case, did you have to wait for the judge to review the file first & then decide to release? Don't see why that is necessary? One could have a spaz attack just waiting for the judge to decide.Hah Hah After being attacked unnecessarily by cops, sitting in court for months, then finally seeing some progress by your Atty getting the file. Now you have to wait another month or so for the decision to be made for it's release. One oughtta get compensated for having to deal with the fiasco of it all. Seems like alot of wasted time and undue stress. |

Thanks Good Dog. Now getting the chief and his staff to admit that is another story. Almost seems like we don't speak the same language. Also, in the UN Code of Conduct for Law Officials it provides that officers use force only when strictly necessary and to the extent required for the performance of their duty. It goes on to stipulate that whenever the use of force and firearms is unavoidable officials shall exercise "restraint" in such use and act in proportion to the seriousness of the offence and the legitimate objective to be achieved. It is obvious to any "honest" observer who looks at the cases under the parameter of the code that the officers, in fact, did not follow code but still,PPD claims they did, at least in JB & JL's cases. Sorry, but those "internal" investigations look like more of a cover up to me. Still think they should include the Town and the citizens on those. |

Sadly in today's world, those who would make good policemen are not pursuing that line of work anymore. Why work for pennies when you can earn quarters and 50 cent pieces in other lines of work?
Thus, all that's left are bottom feeders like these two cowboys. In the old days a police chief with a spine would have fired them in a second and most likely, they wouldn't have been hired in the first place. |

Heard something similar from a retiree from the force who adamantly said those two bozos would have been out of there by now in his department. But see your point about there being no incentive for new officers to aspire to the profession. What do you think can be done to change that? And what about the starting age? Isn't 20 yrs old too young to have the maturity to handle a police profession? |

Yeah well get used to the idea of having a bunch of new cops.. with a town manager like Chuck Roe there will be no lateral cops from anywhere. He gives himself a 24% raise and comes from a town he helped to bankrupt and takes his vacation last month in Hawaii, but dont expect him to hire any new or good cops. |
The Town Manager is Chuck Rough, AKA: Charles Rough. |

Lateral, meaning no seasoned cops. We will get fresh out of school kids working our streets, being trained by the very officers that most of this community detest. |
Actually, I believe Devil's Advocate is limited in her thought process. Actually, we won't need lateral transfers. We are having a whole bunch of veterans coming back from the war. There is a pull down of forces. I believe we will get some experienced police officers that were trained by professionals. The good Ole USA, government trained and government funded for education. They will be an assest to the police force. |

And I believe PG is limited in her knowledge of how Town Goverment works. Our fine town manager is only allowing one position to be filled with a lateral officer. Any others (even if just coming home from a war) will have to go through the schooling and again be trained by the PPD officers. An FTO trains for 6 months before they are allowed to hit the streets alone. They are then on probation for another 6 months after FTO training is complete. |
Aren't you the smart little devil. Don't know the town managers name, but can plug in all there is about officers' training. Amazing! |

No, not so, Dear Devil. Appreciate your valuable information. Thank you for the heads up on what the Town plans to do to improve the Department. Please don't be so easily insulted by Paradise Gal's comments. It's just that she's a little concerned about what you're claiming. So, are you saying that we will not get any experienced officers to serve the Town of Pdse? Only rookies who won't know how to act right when faced with the citizens? Or is that a wrong perception of what you're claiming? |

That is what the claim is. Chuck has only approved ONE lateral officer. Any others that are hired will be fresh out of school. |
