Get your facts straight, the Higgins were never in the pizza shop. The punks started the whole thing when they got drunk, stole some beer so they could drink more and they threw a container at Mr. Higgins car. Even after a guy in the pizza shop told them to leave Mr. Higgins alone and after his son told them he had a heart condition they attacked the son. What the papers don't report is all of the prior convictions these scumbags have. These are NOT innocent up standing citizens of the community. They need to be punished for their actions.
Think of this. If it hadn't been the Higgins in their path that day it could have been YOUR FAMILY. And maybe it wouldn't have happened that day, it could have been another day. These guys were out for trouble and they have devastated a family forever because of their action and the decisions they made. They show no remorse for what happened, none what so ever. There's something seriously wrong with that.

Where were the Palmerton police, maybe Mr Higgins didn't call them but other witnesses did and they didn't get there in time to prevent this even though the police baracks is only a few blocks away.

This is a travesty of justice in the Lehigh Valley. When a person is murdered on a public street in America and the punishment is as few as two to four years in prison; make no mistake, this was murder; not involuntary manslaughter, not simple assault and reckless endangerment; IT WAS MURDER. It does not matter where this incident happened, it does not matter who even started this violent engagement, what matters is that he was a sixty-three year old ex-Marine, husband to a now grieving widow and defenseless against three individuals between the ages of fifteen and thirty. It is my unrest hope that Carbon County Judge David W. Addy will be found wanting as a sitting judge, anyone who would go along with such an erroneous conclusion of punishment should forth with be dismissed from their position of authority. To Attorney Brian Collins, I hope your thirty pieces of silver help to clear your conscience of the fact that you essentially helped Mr. Joseph Roscioli & Mr. Michael Harrison get away with murder, you sir are almost as equal to Judas Iscariot. You betrayed justice for a few coin; may the nemesis of soulless greed become your conscience, may you never know a moment’s piece. Assistant District Attorney Michael S. Greek probably had his hands tied, the shame is that it seem to be that way more times then not, just because sir it is your job to sit there from time to time and take the best deal, still does not make it right. You should have done more. Lastly, to the Higgins family, I believe that your grief in this most terrible of circumstances has clouded your judgment and for anyone to prey on that like a Mr. Collins did most despicably, or allow such an action most cowardly like Judge David W. Addy make them nothing short then judicial parasites. To the Higgins family, my deepest condolences for your loss.

It is no wonder now of days there are more and more law abiding citizens who stringently fight for better second amendment rights in order to protect themselves against harm, the same harm our courts and appointed judges lack to do at what seems to be every turn and a growing trend to “Punish the victim, and reward the criminal”. I for one will no longer live under that yolk. As long as there is life left in me, and I am, able to write and let my voice be counted, then I will no longer be silent, and will post haste voice my distain of a growing and ever faltering disillusioned criminal justice system that both Judge David W. Addy conduct, and the promise of wealth of what the golden calf offers and that which Attorney Brain Collins serves, the same system that holds more contempt for those law abiding citizens who try and protect themselves rather then the criminal. By working in conjunction and passing anti gun laws that do nothing but infringe on the average law abiding man or woman and their rights to life and liberty; rather then a show of equal measure against those who would erode the core of our fundamental freedoms. This would not have happened if Mr. Higgins, Jr. was in his twenties and armed. This sickening display of what I perceive to be the prelude of judicial anarchy is more then its face appearance, it is the right to protection of property and self-protection, the upholding of our judicial and ethical responsibility and not wavering in the face of a plea agreement, and adequately punishing the guilty for their convicted crime rather then reducing their drunken blind rage to nothing more then a sickness caused by social up-bringing and down playing the full measure of the crime, which in this case was murder.

Well said 2nd. Did you see the case similiar to this, today, Andrew Gulich was sentenced to 24 months for the murder of Sean Mitchell. These plea bargains to murders so appalling and obscene.

The aggravated assault charges were dropped but the simple assault charges were not the way I understand it. They also pleaded to reckless endangerment. 2 counts meaning it took into consideration both of the Higgins'

You should post this on the comments made about Andrew Gulich's trial. Apparently the police haven't decided how to charge his brother for what happened outside of the court room. today

He never went BACK to the pizza shop because he never pulled out from the stop light where the carton was thrown at his car. His son turned around and came BACK to look for his father.

Since I am a former LEO and am still certified to know when and how to use deadly force legally, I'd say that I have the certitude to make my comments about what went down between the parties involved. And becoming a victim as a result of your own misconduct doesn't validate your behavior after the fact. So giving me emotionally driven goofy responses to my comments doesn't have a place in the 'use of force' arguments that govern the parties' conduct.
Why is it that you had to bring up a non-point like his being a vet?
Did make him more noble in death here? Am I supposed to kiss his butt and salute too? Or yours?
I'm confused, why?

that I read so if you read
something somewhere else, it
doesn't matter to me. The fact
remains that these 4 perps were
drinking at the time, and 2
illegally as minors.
If, after some time later,
they passed a breathalyzer and
could drive, its not relevent to
their conduct at the time of the
incident when they were more
under the influence. If you knew
when they were tested, and how,
it might make a difference, but
since they weren't driving at
the time, its a non-point.
6.) Since the article says,

It is terrible thing to have happen, but it was almost all Higgins' fault for not using good judgement with obvious bad guys.
The law was on Higgins' side, but he disobeyed it and got the worst of it.
Find something wrong with this, it is the way the law is written and enforced.

self righteousness must feel pretty good judging from your self serving responses... you are all those things you mentioned, that and your insistent 'blathering' proves to all on this board that you sir think most highly of yourself... trouble is people like you will never realize what others see when judging you... to you, you are the only correct one and if others don't see it, you can't understand nor do you care. This is a perfect recipe for an a$$hat... Mr. Higgins is someone you don't know, you did not know his character, yes I did... you make snap judgements based on what you see on the surface... yet you are correct! Just ask yourself, you will be glad to tell yourself just how correct you are..God it even seems you write in prose... tell me where to mail the mirror and I will also mail you a crowbar to get that stick out of your self righteous a$$.
