That's nice, like I said, it isn't hard to eventually find a court and a judge to rule in your favor. You simply have to keep asking the same questions and different courts until you finally find someone to agree with you. This has nothing to do with Constitutionality, it has to do with activist judges whom inject their personal bias into their decisions.

And it hardly "stop's" here, as the SCOTUS has avoided this hot potato thus far.

You are doing exactly what the court has done in an attempt to circumvent the Constitution, it's called case law. Case law has nothing to do with the Constitution, it has to do with cherry picking previous decision's- good or bad, right or wrong, Constitutional or not- and using those decision's to further their cause. This has nothing to do with the Constitution. Remember the "telephone game" in school? Remember how messed up the original message was after simply passing through just a few people? That is what case law does to the Constitution. The fact that you are required to cherry pick court decisions in order to prove your point, rather than cite actual statement's of those who drafted, debated, and ratified the 14th Amendment shows how little you position has to do with the Constitution, and how much it has to do with personal bias. Look I can to it too- Hernandez v Robels.

The court was never intended to be the end all be all of what is and is not Constitutional. That was left to the State and the people. Thomas Jefferson and James Madison (you know, the "father" of the Constitution) proved that. Go read the Kentucky and the Virginia Resolutions.
