If they win,
they will have to give half of the settlement to Raye Dawn.

Curtis is a drug addict in jail, Raye Dawn is in jail for enabling child abuse, and about to be up on charges of murder. Raye's lawyer had the option to call Whitney, but did not when he found out what Whitney really knew. But, when Raye is brought up on murder charges, I bet the prosecution will have Whitney on their witness list. Kelsey told her mother repeatedly that Porter was abusing her. I think my personal favorite on Smith's list of reasons for appeal is that because the person interviewing her for the presentencing report yelled at her.

Whitney said something about they thought her dad was the one who hurt Kelsey. This was the second time she had brought this up. I asked her if her dad had ever hurt her. She said no. I asked her if he had ever hurt her brother. She said no. I asked her if she had ever seen her dad hurt Kelsey. She hesitated then said yes. I asked her if she wanted to tell me about it. She said yes.

She told me of the time she heard Kelsey getting a spanking. So she went upstairs and looked in the doorway to find her dad spanking Kelsey "real hard." She said he spanked her so hard it left her bottom "real red." She added, he spanked her until she threw up. Whitney also observed that when her dad went downstairs he did not tell anyone that he had spanked Kelsey or that she threw up. I told her it must have been hard to see that.

She told me that when people were around her dad, he was nice to Kelsey. But, when no one was looking she said her dad was mean to Kelsey. I asked Whitney how she saw these things. She told me that her dad didn't know she was watching.

I told her that these days they have DNA testing and they can tell who did what. I asked Whitney if she felt better telling someone what happened. She asked me if her dad would find out. I told her she would be protected when that time came. I asked her if she was ready to go back to class. She said yes, and I walked her to class.

Why wasn't the counselor called as a witness? Because it was a lie.

I've been asked a million times if Kelsey could talk

and the answer is "Yes,

she could talk up a storm as if she was half-grown."
Then I've been asked,

"Did she ever say anything?"

Yes, she said some things, such as:

"I don't like Ashley!" (Kelsey's stepmom),

and "I don't wanna go see Kafie (Kathie)!"

The District Attorney Richard Smothermon stated publicly tha
t I "should have known",
but he told former judge Craig Key in private that he KNEW I was INNOCENT,
but because of the other family,
he had to charge me with something.

Now this man,
Richard Smothermon, is wanting out
of office to become a
workman's compensation judge.
He still has two years to serve in office.

How loyal is he to the community
and district he has promised to serve?
Plus, he doesn't even live in the district where he serves as a District Attorney.

He lives in Edmond.

State officials have been informed of this on several occasions,
but nothing has been done.
Why? A lady running a tag office had to shut her placeof business down because she didn't live in the same county as her tag office,
but there is nothing done about a District Attorney doing the exact same thing?
Richard Smothermon has made the statement that the "Kelsey Case" has done him in.

If he had done the right thing in the first place,
what he KNEW was the right thing,
he wouldn't be in this predicament.
Richard Smothermon told my attorney, Steve Huddleston,
that he "Didn't have a problem with my mom having my son
and me being supervised by my mom"
but of course DHS didn't allow it, because they were already getting
call-ins about my son
and I didn't even have him.

Now does that sound like a District Attorney who really, truly believes a mother enabled child abuse?

One of his friends was there and witnessed the blow, but he said and did nothing to stop him. Lance wanted to go see the movie "Me, Myself, and Irene" and the pain wouldn't stop. I stifled my tears and sat through the movie with him so he wouldn't hit me again. After the movie, we went home and the baby went into the toilet. I went to the hospital where I was told the baby had detached from my uterus. Lance paced the hallway and said if something was wrong with the baby, he didn't want it. I was devastated! Lance, again, promised to change and I believed him. We married shortly after that awful night and the abuse continued for two more years. In 2002, I finally found the strength to leave him. I began seeing another man and Lance continued to stalk me, break into my home and trash it, and threaten me. I didn't know what he was capable of doing. We divorced and he moved on to marry a 19 year old girl. When I discovered I was pregnant, all I wanted to do was protect my child from Lance. I didn't know if she was Lance's or my new boyfriend's, but I PRAYED she didn't belong to Lance. After three days of labor, on December 28, 2002 I gave birth to Kelsey Smith. She was my entire world!
