Criminal Penalties In June 2005, the U.S. Department of Justice (DOJ) clarified who can be held criminally liable under HIPAA. Covered entities and specified individuals, as explained below, whom "knowingly" obtain or disclose individually identifiable health information in violation of the Administrative Simplification Regulations face a fine of up to $50,000, as well as imprisonment up to one year. Offenses committed under false pretenses allow penalties to be increased to a $100,000 fine, with up to five years in prison. Finally, offenses committed with the intent to sell, transfer, or use individually identifiable health information for commercial advantage, personal gain or malicious harm permit fines of $250,000, and imprisonment for up to ten years.

First and formost, abortion is MURDER!!!!! Say all you want about Lance and Kathie, but remember one thing people....they were no where around when thier precious baby girl, and baby granddaughters life was taken. Nope....she was in the care of her mother Raye Dawn. Who she chose who she wanted in her life, around her daughter, and left her daughter alone with.Who was obviously so blind, she couldnt tell anyone was abusing her precious child. Or, she was letting it happen. You want to blame someone for the murder of beautiful innocent helpless Kelsey Briggs?? Only one person to blame...the person that had her and that would be her mother! You all know it is the truth and to damn afraid to admit it.RD hasnt been terrorized by aanything but her own doing, what she let happened to her own daughter! You expect the Briggs to be silent and not angry as hell with RD, being she let thier (grand) child be abused and murdered?????? Then what kind of people are you?? Its time to realize the truth, and stop blaming others when nobody else was there! GET REAL PEOPLE!!!!! RAYE DAWN IS GUILTY AS CHARGED!!!!!

I am just as free as anyone else to get and give information no matter what I do for a living. As long as SMith was not my patient or the patient of the person who told me. Smith does have siblings and "friends" old friends who knew and are talking about it. I can't see any reason that the person who told me would lie expecially since I knew absolutly nothing about the case at the time. Again, THis response was directed at Sue right after she accused pretty much all of us of either having had or performing abortions. Who gives a crap anyway? As far as HIPPA goes, in many ways the law actually errodes confidentually and privacy. For example: if you go to an ER your visit will be available to any other ER alreay on line.

Sorry Badger, Nope I did not do any of this and BTW it would be easy to find out if I had. Lets get back to the topic at hand, which is Smith's killing Kelsey.

Bee wrote: <quoted text> WRONG!!! It's called double jeopardy. Do you really think Smotherman wouldn't have charged her w/ murder if he could prove it? She can't be tried for murder, she's already been tried. She was never charged with murder, nitwit. She was charged and convicted of Enabling Child Abuse. That is not murder. Therefore, Raye can be charged with murder. And look to see that happening really soon.

You, as a health care worker, should know better and be above that. Obviously you are not who you claim or a really sorry medical professional. I hope you are just a liar and not really working in a field that deals with person's most personal information. "Who really gives a crap"? Everyone does, I bet Follet and Ballard do too. What's the name of the book you are helping them sell?

"Who really gives a crap"? Everyone does, I bet Follet and Ballard do too. What's the name of the book you are helping them sell? You have absolutely no idea what you are talking about. HIPPA is when a health care worker takes care of a patient. Let me break this down. If I had taken care of Raye Dawn when she had this alledged abortion, and told someone who had no medical reason to know, then I would have violated HIPPA. Since I never took care of Raye Dawn, no did I have any access to her medical records, and only repeated rumor, then I would not be guilty of violating HIPPA. As health care workers, we have all had HIPPA shoved down our throats. But it is for the patients that we have access too, not people in the general community whom we know or heard about. That said, I don't see how Raye having an abortion or not having one has anything to do with the case at hand. A living breathing child died while in Raye's care. You can not get away from that anyway you look at it. You can try all you want to explain it away, but the fact is still there. We have had to put up with Sue for months coming on here, accusing people of abusing Raye (simply for speaking their opinion on what happened) and being responsible for the death of Kelsey. We have had to listen to her insane ramblings accusing us of abortions and other moral offenses and when something is pointed out to her, you English jump on the Raye Dawn bandwagon and begin to issue threats, and having American law pointed out to us when really, you know nothing more about it then what came up in your search results when you googled it. But the pettiness aside. You know as well as I do that Sue is looney as a tune. That has nothing to do with your belief of whether Raye is innocent or guilty. You have that right of your opinion. But we also have ours.

I was going back over a few posts trying to find out where the accusation is that ElHalfpenny violated HIPPA, so far haven't found it, but when I re-read this I wanted to say something. And please take note I am not trying to be disrespectful or argue lol Your encouragement of Hope in this post, is it because of my post to her? I'm baffled that you of all people would encourage outright lying and misrepresentation of truth, no matter which side of the fence the truth falls on. Being compassionate about one's beliefs is admirable, outright lying about someone is not. As you know, I have alot of respect for Shonya. She is very factual, and I have never found her in a lie. Now if it was proven on this board that she had lied, I may not say anything at all on here, but if I did, I know it would not be words of encouragement or any type of "atta girl" pat. Hope's videos contain outright lies also. Kathie did not break Kelsey's legs, the AG NEVER stated that she did, etc, etc.(not listing them all) I'm finding your encouragement of someone's consistent, malicious, outright bold faced lies, very troubling and confusing to me this morning I guess. Hope you see this for what I'm trying to say and not as an attack of any sort on you, I just really am baffled by what I read. Have a great day! Repulsed in NY wrote: I have to wonder why there is no answer to my post from ELHalfpenny. A person who demands proof but can not provide it. A person who hates when assumptions on made but doesn't mind making them on others. Just wondering... Where is Ms. Shonya??? I really am missing her posts, she may get upset and defend her point of view but she brings a whole lot more sanity to Topix then what I am reading lately. Good evening NoUse and KV...hope this night finds you both well and Blessed :) And to Ms. Hope...Stay Blessed and stay strong, I find you to be a very smart young lady who is as compassionate to your beliefs as other are to theirs.

OHH! That is what they are talking about lol. No wonder I couldn't find where she violated HIPPA, because she didn't. Thank you for explaining that for everyone to see. I didn't get that it was RD they were talking about. Again thanks. The DIVA wrote: <quoted text> You have absolutely no idea what you are talking about.
