If you studies history and civics in elementary school, you'd be able to answer your question. If a majority of the population agrees that a minority should be discriminated against and their constitutional rights infringed upon, the Supreme Court of the U.S. and of the States have the responsibility to overturn those laws - whether enacted by Congress, the legislatures, or by voter initiative. Interesting that six of the seven California justices were appointed by Republican Governors, and that all have been confirmed by the voters.

This is exactly why we have courts, why we live in a society where we elect representatives (and they appoint people like judges) to have the authority to make decisions like these. The majority isn't always right, and we're lucky to have a system where there are some checks in place to assure those in the minority can have their rights represented fairly.

I am atheist and i do not believe in gay marriage. I know a lot of people who think the same way. Please don't try using the term religious to tag all of us with. By the way, the people in the Middle East that you think that we cam talk to and reason with, would put you in front of a firing squad for being gay. I don't care what people do behind closed doors.

We are a republic, not a theocracy or a democracy. Equal protection and equal rights are extremely important in our form of government. To designate one group as more important and therefore worthy of more privileges and rights goes contrary to our Republic.

Our nation is trying to go backwards. We have groups of people that are willing to dismantle our Constitution to make some religious nuts feel better about their lives.

These 3rd gender people know they are they wrong. They will all ultimately answer to GOD.

Really? Hmm, so you are comparing pedophiles to homosexuals? Interesting. That means that you have no real argument. Here's the point. According the this "great" country (which I am learning is full of biggots), we all have the right to pursue happiness. So, who are we to keep these fine people from sharing that same right? Because others are uncomfortable with what they do in the bedroom? How does this great achievment in the law change my view on marriage and my vows with my husband? It doesn't. Marriage is about love and God in some form or another. If this is a "God" issue then I think the God that everyone holds dear is cruel to put people on this earth with such hate for others. It's sad really. I have two daughters and if by some chance one or both are lesbians, then I want them to have the freedom to live their lives and pursue that happiness.

Save your anger for the November election. Everybody gets to vote, so make it count.

I'm guessing the Obama voters will tend toward the gay end of things while the McCainiacs will be more more up front and traditional.

But who knows, and thats whats great about living in a Democracy. We'll have the vote and about 50% of the people will be totally pissed off while the other 50% gloat.

Perhaps soon your State Supreme Court will rule that it shall be unlawful to fail to engage in homosexual intercourse on demand from anyone who so petitions.

I have never understood the concern people have with the sexuality of others. Why is this still an issue when in places like Europe no one really cares.

So now we are going to hear candidates debate this issue? More important are the issues of illegals, health care, environment and jobs.

Wake up people. When your social security is cut or Medicare benefits reduced I assure you won't be thinking about gay marriage!

Those organizations that disagree with the homosexual agenda, which they have a right to, and will not place children up for adoption with a gay couple will now have the state march their way in and say, "do it our way or go away."

Even though these organizations believe that a household with a mother and father is far more fiiting for the development of a child, they will once again be forced into extinction by the gay lifestyle and liberal lawyers.

Answer me this, how can a gay man possibly explain to his young adopted daughter in the way only a mother can about her monthly cycle? Can he speak from experience?

So once again, we have the wonderful decision of four judges overturning the will of 61% of the California voters to satisfy a very small percentage of homosexuals. What next? Hey, let's get rid of Prop. 13.

I am attending a wedding of two beautiful women today and as a straight married woman I am so proud to have them among those of us who take marriage seriously and marry for love. I've no doubt these two are in it for life and that's the best representation of marriage I can think of.

If gays are redefining marriage, as someone earlier suggested, then it is long overdue, as today's youth must think it it is defined as being "a phase some people go through". The practically inevitable divorce process in southern california lasts longer than the marriages. All I'm saying is the supposedly sacred institution of marriage has already been trivialized... by straight people.

People in love who have longed for and fought for the rights they are due as citizens of our country are bound to take marriage more seriously than half the straight people I know.

And to the people whose argument is interspecies marriage? Who gives a bleep?? If you want to marry your dog then go ahead! It doesn't make my marriage any less meaningful to me.

The Supreme Court isn't telling religions who can or can't marry IN THEIR CHURCH; religions can continue to discriminate just as they've done for centuries, when they say that blacks can't marry whites, a Catholic can't marry a non-Catholic, etc. How does the fact that two gays marry one another in another religion or in a civil ceremony affect my marriage to my wife one iota?
