you are right, but isn't it listed on the MDL, that around 1770 have died SINCE this whole recall started, not meaning they died from unit failure, but died after signing up for this case?<quoted text>
The reason you can't find a quote for death due to Guidant is there is NO WAY TO SAY( for sure) THE MACHINE CAUSED IT. This I got from my attorney's who are right up there in the top of all of this. There were NOT 1500 killed by these machines, then we would be hearing about things. The death's that happened and were attributed to the machines are less than 10.

I don't know I think there are more than 10, lets take a pole, considering from the beginning we were told my father's death was the 6th and on this post I believe I have seen at least one other stating they were number 6. so how many on this post believe or have filed a wrongful death??? I'm 1 lets count Mary

that is the first site I have seen that had alledged deaths listed, thanks, the other site is jut for people who are filing for ones that have died, not just from unit failure. |

the first site is from southern friend, up above mine a few lines, and has people listed who died from potential unit failure, the site I have listed, is how many are filing for relatives who have died, but not from unit failure, just patients with units |

Is there still a company called Guidant to Bankrupt? I don't think you are suggesting that Boston Sci, be made bankrupt because they bought Guidant are you? If any firm is made bankrupt by any suit, I believe they can reorganize inder BK, and wipe out the debts or pay pennies on the dollar, so then what did you gain? I would suggest that the ones to blame for not disclosing defects should face charges. |

has anyone heard anything else about when they will start sending monies out to the clients . will it be around dec.of2008 or jan.2009 curious because i,m involvedin this case my lawywer is in alabama and i,m waiting also for this lawsuit to be over with.

fireyes: No one on here will know because our attorneys tell us nothing..perhaps because the judge and Zimmermann's group do not tell the attorney's anything either. This is all a big secret between Lead attorneys' and Guidant!

last conversation with Lead Attorney, was the cutoff for deceased on 9/1, then the 95% thresehold review, then cut checks. Most likly very late fall, early winter cold be 2009(early I hope)Loading data from all the cases in computer now, thats waht the current disbursements have been for.

yes Jim, the system does have us all down now, along with this heat wave. I guess when there is nothing new to share, no one writes, a couple of people on here said they were to get leters from their attorneys, we have NEVER gotten any letters from ours, has anyone else????

My lawyer is part of the steering committe, they said checks should come late November.

We are hearing about cutting checks from some but does anyone know how the 95% ceiling is going..is there a 95% participation in this settlement? Does anyone realize that we all thought this was over last SEPTEMBER????

We received a letter from our attorney Tuesday after having called on Thursday. Here it is:
I am writing to give you an update on the status of the Medtronic Litigation. As you know, there is a federal procedure for transferring hundreds of similar lawsuits to one judge and one jurisdiction. That was done with all of the Medtronic Heart Device cases several years ago. The cases were consolidated before one judge in Minneapolis, Minnesota. The cases, of course have been settled and the various deadlines that have been set in the past for the payment of funds have all been extended for one reason or another. Most recently, we have been told by Lead Counsel that all settlement funds would be distributed on 6/20/08. On 6/19/08, the Judge issued an order saying that the dispute over the common benefit attorney's fees would be set for hearing on 8/20/08, and that until that hearing no funds could be distributed. The dispute over common benefit funds has nothing to do with you or my law firm. The setting of the hearing on 8/20//08 is not the result of anything that we did or failed to do. Lead Counsel has filed a motion asking the Court to allow him to distribute 40% of the settlement funds to claimants without any payment of attorney's fees. The rationale of asking to disburse only 40% is that money would have to be held back to pay attorneys' fees as well as the liens any third party payors such as Medicaid or Medicare. That motion has not been ruled upon and I have no idea if the Judge will grant it or deny it or when he will rule on it. All we know is that the common benefit fee dispute has been set for hearing on 8/20/08 and at this point in time there will be no distribution of funds until sometime after 8/20/08. I know that all of you are very frustrated with the slowness of this process. I can assure you that my firm and I are equally frustrated. However, at this time, there is nothing that can be done to speed up the process. When we learn anything new, we will communicate with you as quickly as possible. A few days ago we received a short letter with another form to sign declaring whether we know of any medical bill liens that would affect our settlement. The letter was short, asking for the attached form to be signed. There was no explaination or any other information.
The letter posted from "troubled wife" gives more information and explaination than any I've seen. And, what is not surprising, the lawyers are more concerned about what they are going to get rather than the victims. It's my understanding that the fee to the client is in a range from about 20%-44%. This is to come out of any settlement amount we get. It does not include the millions from Guidant to be paid to the lawyers. I believe the judge awarded the lawyers a fee of 22%(or an amount close to that), so any lawyer who had his client sign to pay a percentage over that amount is getting cut back. Is this the "common benefit" to which her lawyer is referring or are they disputing the other money that they are going to be paid? I can't imagine they would make an issue of the small amount they would be losing from the client's settlement portion. That would be just plan greed heaped on top of insult. |
