NEW BOSTON—The lead defense attorney in a Bowie County murder trial was arrested Tuesday on his way to the courthouse, prompting the judge to declare a mistrial.

Attorney Bryan Simmons of Atlanta, Texas, was involved in a single-car accident on Highway 8 near New Boston. He now faces a first-offense DWI charge, according to the Texas Department of Public Safety.

“I know he wasn’t drinking,” said Simmons’ co-counsel, Mitch Collins of Tyler.“He’s been up for days preparing for this case. He hasn’t been sleeping.”

Simmons, 38, was released on a personal recognizance bond shortly after being booked. Collins said Simmons requested a portable Breathalyzer test at the scene, but it was not administered. Instead, Simmons agreed to submit to a blood test.

The results of blood tests taken at the request of law enforcement are typically available about two to six weeks following administration.

Simmons is the Cass County Democratic Party chairman and is also the lead attorney for capital murder defendant Kevin Hailey—the suspect in an infamous triple homicide in Cass County. Haley faces the death penalty if convicted and is set for trial in September.

After dismissing the jury panel, 102nd District Judge John Miller spoke to Davis and Collins.

“Mr. Davis, I haven’t been confronted with this situation in my 35 years of practice and on the bench,” Miller said.“He could have voluntarily taken something that caused a physical impairment or something else could have manifested itself to give that appearance.”

I don't think much of judge Miller either.
Yet I see an attorney being harassed.
Could be they may be filing law suits on DPS.
You know the incompetent who writes tickest on the dead.

On of his alibi's for him the night of the murders is now a APD cop.

He is a admitted drug user and dealer.
Yet he is also a cop.
