Crown Point man arraigned on murder charge

ELIZABETHTOWN -- A Crown Point man was charged Monday with the murder of his brother, who died from a gunshot wound to the head in June.

David R. Lang, 70, was arraigned in Essex County Court on charges of second-degree murder, a felony, and fourth-degree criminal possession of a weapon, a misdemeanor.

Lang pleaded not guilty.

Lang, of Lake Road in Crown Point, is accused of firing a small-caliber rifle that killed 63-year-old Russell D. Lang on June 19.

Russell Lang was transported to a hospital, where he later died.

The men lived together. The incident happened at their home.

Lang was originally charged with attempted murder, but the charge was elevated to murder.

Kristy Sprague, the Essex County district attorney, did not want to comment on the motive behind the shooting, but said the shooting was intentional.

“He shot his brother in the head. He is charged with intentional murder,” Sprague said.

If convicted, Lang could spend 25 years to life in prison, Sprague said.

Essex County Judge Richard Meyer set bail at $1 million cash or $2 million bond, which the district attorney had requested.

Lang, who is represented by a public defender, will return to court on Nov. 15
