Constitutionally, the ACA individual mandate can only be either a TAX or a PENALTY. In finding the ACA's individual madate constitutional, the Roberts majority decision ruled it was a TAX. Not a 'tax penalty'- a TAX. Constitutionally, there is no such thing as a 'tax penalty'- it is either one thing or the other, as much as the Obama/Pelosi/Reid cabal of progressive hacks immediately went into overdrive trying to spin away and obscure the Constitutional reality.
According to the highest court in the land, the ACA's individual mandate is constitutionally a TAX. Period. Deal with it.
