McKeesport Solicitor John Jason Elash Faces DUI Trial

A local municipal official faces a criminal trial resulting from a January DUI, after waiving his preliminary hearing on Monday morning, reports the Pittsburg Post-Gazette. John Jason Elash is the Solicitor for McKeesport and has held similar positions with a number of towns over the course of his long legal career. A Solicitor is essentially a jack of all trades attorney for the city that researches and advises them on legal issues and regulations.
According to the Post-Gazette, Elash was leaving the inauguration party for Mayor Michael Cherepko when he crashed his SUV into a building in the 700 block of Route 48. After being taken to the hospital for a head injury, his blood alcohol content was allegedly measured at 0.196, which is more than twice the legal limit. He was also cited for speeding.
If he is convicted of a highest-level BAC (0.16 or higher) first time DUI offense, he faces some pretty severe penalties. The charge carries a minimum of 72 hours in jail, with a maximum of six months.
Because he was in an accident, he probably won't get the minimum penalty. There is also a fine of $1,000 to $5,000 and a 12 month license suspension, plus alcohol education classes and possible court ordered alcohol treatment.

I don't think it is a first offense. The penalties can be much more severe. I believe he is looking at 90 days in the joint. They will love a pretty boy like him down at the County Jail.

Segina and you other sore loosers should lay off Elash. Had accident, will deal with it. No one hurt but him. He is an asset to the City, does a fantastic job and has for 9 years. Segina keeps after him because Elash backed Cherepko when he was fired. Segina was public works director at City for years. When he was there scrap was sold for cash, Segina would keep the cash and provide no records to the city, he now says he used it to throw parties for PW employees. This was illegal then and now!! But now he wants police chief to call da to investigate the same thing being done by current PW director? And Elash's DUI? My buddy told me that after the March meeting Segina sat at a bar and had 4-5 shots of whiskey and 3-4 beers in an hour and a half then got in his truck and drove home!!! My buddy says Darryl has gotten drink after most council meetings then drives. If this is true, should we put a clause in this lowlifes contract?

Segina ran International Village from like 2002 till 2009. Under his watch all money was collected and taken to a trailer. It was then put in a bag and deposited in the bank...without being counted!!!! Attendance was figured out based on the deposits. So if Darryl and friends were skimming....no one would know!! Same with pop sales!! Interestingly, when Brewster took over money has now been counted and...magically attendance is much higher!!! Smells shady to me Darryl? Have Malinchak investigate this!!! Please!!!!!

Judge Gives Texas Man 45-Year Sentence For Latest DWI Conviction

Fort Worth man must serve at least 11 years of sentence. Last week, New Jersey officials expressed exasperation with their inability to keep a drunken man off the road after he was arrested for driving under the influence five times in a five-week span.

Perhaps they can receive some legal advice from their counterparts in Texas.

A county judge in Fort Worth sentenced a man to 45 years in prison last week after he was convicted of his fifth DWI. In Stephen Andrew Hall's latest case, his blood-alcohol content was .18, more than twice the legal limit. Jurors convicted him in four minutes.

Hall, 59, must serve at least 11 years of the sentence, according to Time Magazine. Although he chose to have the judge determine his punishment, he later said the punishment was "pretty weak," according to the Tarrant County district attorney's office.

The office told KSEE-TV that the punishment was appropriate, "considering his prior DWI history.(The) sentence ensures that he will not be able to drive a vehicle on our roads for a very long time."

In Vineland, N.J., Anderson Sotomayor had five arrests in the past five weeks. Those cases have not yet gone to trial. But he has two prior convictions for DUI, and his license has been suspended 23 times.
