I think this is very sad when our justice system fails these children. And one year for his actions is definatley NOT justice.

I certainly understand why the representatives are angry. But if the child's family & the DA agreed with the plea bargain, then I can only assume that the representatives are doing this for political points, which is pretty disgusting too. If the reps were really interested in correcting a problem, then I would suggest thinking of way to help a small child testify in court. One idea would be to let the kid testify from another room via CSTV. I'm sure there are other ideas too.

Good for these two State Representative and how dare this judge. And I certainly hope this MONSTER who did those horrible things to this poor innocent little girl gets way worse done to him in prison and dies from the pain and suffering.

What a joke. Our legal / justice system protects only the lawyers / judges. Where are the protection for the people, in the case a little girl. I feel ashamed to live in OK with all the injustice that is taking place lately...an OHP chokes an EMT and isn't charged, a pharmacist shoots a would be robber in self defense and is treated like a criminal, and now this. What a joke.

Absolutely. These types of offenders are NEVER rehabilitated. For lack of better terms, uh-hum, they NEVER are cured of this sickness. I say they should lock them all up and throw away the key. Perhaps off the topic, but while I'm stating my opinion...
On a recent visit to an Oklahoma penitentary to visit my brother, who's a non-violent offender - unfortunately for him, just a screw up -, he pointed out a few of these monsters to me in the visiting room. I had one pegged before he even told me what he was in for. I just watched this man's body language and his overall demeanor...something just didn't sit right with me about the guy. And, it was so disheartening to see these monsters in a visiting room where young children and teens were visiting family members. Shouldn't these prisoners loose visitation rights...especially when there will be, more than likely, children in the visiting rooms? Again, I ask, who will protect our children??? Just makes me sick and very angry.

This judge is a POS! And he definitely made the wrong call....he should be disbarred! Let Earls go ahead and serve his ONE YEAR SENTENCE, but throw him in there with Big Daddy Long Dong....and lets see how much of a man he is!!!! He wont last a year!!! Maybe Big Daddy Long Dong can have a visit with Bartheld too!!!

I followed this story on Fox News. Bill O'Reilly and Geraldo Rivera had a story about this grave injustice last Friday. Geraldo Rivera actually went to McAlester to speak to both the Judge and DA but neither one had the guts to discuss their actions. Rivera spoke to the girl's mother who broke down in tears during the interview. O'Reilly called both Governor Henry and Attorney General Drew Edmonson on Monday to ask them to investigate the Judge and DA. Mr. Henry never returned O'Reilly's call and Mr. Edmonson stated he was "to busy" to look in to this horrible travesty.

On one hand i see the parents not wanting to put their child through anymore hurt, but then again this old man is sick and needs to die in prison. Did they never think of taping the little girls statements? Or having her seperated and and ask her questions over a telepromter?

That is disgusting! How can a man get 1 year for raping a 4 year old girl?!?! He'll be out in a year and hurting another child! The punishment is not severe enough. That judge should be ashamed of himself!

This really gets my dander up. The girl should have testified via video like some other posters have suggested. I hope the family can sue this sicko for everything he has and set up a trust fund for the little girl. He should also be stripped of any social security benefits he recieves and the money given to the girls trust. As for the judge well he should lose his job over this. Disgusting.
