Deputy District Attorney Leslie Fernandez and the juvenile probation office had asked during Wednesday's hearing that Acevedo be committed to a state detention facility for one year and while there undergo counseling and treatment as deemed necessary.
Prior to the sentence being announced, Acevedo's former girlfriend, whom police reported as 13 at the time of the crime, told the judge that since the crime against her took place she has had trouble sleeping and is scared to be home alone. Shortly after the incident, she told police that during the attack, she told Acevedo to stop and tried to push and kick him off of her.

In the plea deal, Acevedo "admitted" - equal to pleading guilty if he were an adult - to one count of criminal sexual penetration. In exchange, the prosecution dismissed one count of burglary that was charged in the case because Acevedo had entered the girl's house uninvited through a window. The prosecution also dismissed a separate but related case in which Acevedo was charged with intimidation of a witness and violation of a protection order in connection to text messages.
