Now you got to watch the older people. i don't mess with them. i think i have had about 6 wrecks and 4 of them was older people hitting me. anyway no he did not have the right to shoot if they was driving away.

By the way - the young innocent man who was critically injured has a criminal history which includes Assault, Auto Theft, Theft of Property, Theft of Service, Possession of Marijuana, and Failure to Appear. The other occupants of the car had a Theft of Property, two Burglaries, and a Possession of a Controlled Substance charge between them. I'd say, based on the law, and what we now know about the three suspects - Mr. Oaks used reasonable judgement when he decided to shoot!
TEXAS PENAL CODE SEC. 9.43. PROTECTION OF THIRD PERSON'S PROPERTY.
A person is justified in using force or deadly force against another to protect land or tangible, movable property of a third person if,
under the circumstances as he reasonably believes them to be, the actor would be justified under Section 9.41 or 9.42 in using force or deadly force to protect his own land or property and:
(1) the actor reasonably believes the unlawful interference constitutes attempted or consummated theft of or criminal mischief to the tangible, movable property; or
(2) the actor reasonably believes that:
(A) the third person has requested his protection of the land or property;
(B) he has a legal duty to protect the third person's land or property; or
(C) the third person whose land or property he uses force or deadly force to protect is the actor's spouse, parent, or child, resides with the actor, or is under the actor's care.
Okay you QUOTing the law and all of that. the first thing the old man should of done was pick up the darn phone and call the cops if he thought they was doing wrong. i lived donw in Texas and i packed a gun. i used it two times and it was because i had to. i did not shoot people driving down the road that is insane. you may have all of them right to do that things you say. but it is a old law that they need to update just for this reason. i have had people walk down the road and even into my yard. they was taking a shortcut. i did not shoot them. that old man needs to go some place where there is someone there to watch him. LIKE A NUSING HOME. you don't shoot people just for being in the road next to you yard. DUMB DUMB!!!!!!!!!!

I just read this topix and was suprised by all the comments against the shooter. As someone stated above, to bad he didnt hit all 3. These fellows need to be caught and shot.. the problem with society is that no one respects the law or folks anymore. I guarentee you start shooting robbers, crack dealers and thugs on the spot, your crime rate will go way down.. these folks will get the message that if you commit a crime be prepared to face justice. Criminals realize they can get away with a slap on the hand so they dont care... good for mr oaks... i say kill all the theives...
