The last statement in this story is the telling one. Why shouldn't the law be changed to permit a past record...especially if it is for the same offense...to be admitted into evidence. In this case after his second offense he should not be permitted to ever drive again. If he was apprehended for DUI, he should have received prison time. In this case he should be tried for murder. To me malice was shown when he didn't stop & apparently had no intention of stopping. How has this affected all the previous families where this guy was involved? That becomes the mitigating factor.

No one should ever have the chance to be convicted, repeatedly, of drunk driving. It is clear the guy has a problem he was not in the least bit willing to fix, and now he killed an innocent person. Hard labor for the rest of his life seems fair, but what do we bet he'll get instead?

Give this piece of human trash life in prison that way he will never be behind the wheel of a vehicle again . He has had 4 previous dui's and did not learn a thing from them . He did not stop after hitting the motorcyclist that shows he did not care who got hurt and he also failed to render any aid at all. This guy deserves a life sentence in my personal opinion !! My heart goes out to the victims family .
