TO UPDATE EVERYONE WHO HAS BEEN FOLLOWING THIS HORRIFIC STORY:
A Grand Jury convened and voted to indict the 24yr old driver of the van of Manslaughter 2, Vehicular Manslaughter, DUI and possession of marijuana. He was arrested on May 22 and arraigned on May 23 in First District Court. We were present at the arraignment.
This was due to the hard work of the all the detectives who worked this case, a wise and fair Grand Jury and the Nassau County DA's office who is working hard to protect us against people who disregard the law and do not value the their lives or the lives of others. We need to support their efforts and let these offenders know that this is not the Wild Wild West. This driver was driving recklessly and impaired on a rain soaked road. Had he been driving clear minded and defensively he would have been able to avoid this accident with the Trailblazer that was making the illegal left turn onto Merrick Rd. He took down a tree, a parking meter and a cable attached to the ground before killing my son, the van then hit a parked car that hit another parked car which was thrown into a side street. My poor son did not have a chance against this speeding rocket, I can only hope he did not know anything.
I don't know how far this will go and what his sentence will be. I hope that there will be an example set and this offender will be taken off of our streets.
We are losing people everyday to irresponsible DUI and DWI drivers. I would never believe that that this could happen to my son while walking on the sidewalk but it did and it could happen to anyone or anyone's child.

today is my daughters 5th birthday party, and i am upset that chuck is not here to see my daughter turn 5. chuck is a close and dear firend of mine, he was my BEST friend. chuck only kept of close friends i huess he was/is smart and know how the world could be. i know of chucks brother he is 2 year's older then me and his friends lived around the block and i played with the girl across the street. i knew chuuck, known his borhter (i thoguht he was so cute and i use to watch what classes he went to but he didnt know me) and grew up with the people that he hung out with. so chuck wasnt just a person i knew chuck was a dear friend to me and my borhter and my family, my mother even took him to go see bob dylin. chuck was part of my family he was chris's friend. i am so devastated to because chuck did make a diffence in my life. ha had seen my baby when was an infant to a toddeler and now its my baby's birhday and he is not not around to see her to turn 5. So therefore, i cant help it to feel sad, im only human and i have emotions. I know chuck is still here, i just know it. i feel his persents and i feel like he wasnts me to be happy and enjoy my day. but i just wanted to expess my feeling's because this young man made a diffence in my life.

Thank you for all of your kindness and for keeping Charlie's memory alive. He was a wonderful son and he is a beautiful spirit. I too believe he is around us and he lets me know that he is. Happy 5th Birthday to your precious baby, enjoy her. She has a special guardian angel now.
Chris and Charlie were good friends and last year when they went to see Bob Dylan in AC was very special to Charlie.
He talked about it for days, he was so happy. I am happy that he had that opportunity.
He was blessed to have a caring friend like you.

Yesterday was 45 weeks since we sang together Charlie. I miss you so very much. I miss your smile, your voice, your laugh...........I miss everything about you. I will miss the future we should have had together that was stolen from us. I will miss all the things that a mother dreams of sharing with her child. I will keep you close to me always baby, it's not the same but it is all I have for now. I love you my baby.

Well Charlie...I can't believe a whole year has passed and I haven't seen your smiling face and warm hi! You are like another son to me...you & Rob...like Irish twins. my heart is still broken. i feel like i dont want to even wake up a anymore, when chuck died it felt like my own brother died because of the fact that chirs is a year younger then me and he was my little buddy and chuck hung out with my brother each day so therefor chuck was my little buddy. and when chuck got plowed down by that car it felt like my little brother got plowed down by a car. Chuck was like family, lynbrook is a very small village and know that lynbrook wont ever be the same without chuck.

I found out today of your terrible lost, i am heart broken about the news. I know that charlie was a great kid because of all of you. You are the reason I am who I am. I was just a pain in the butt that lived around the corner and you made my a part of you. You are loving and giving people that do not deserve this. Today there is an article in Newsday, page A16 "Charges axed in fatal crash".
The laws are written for the criminal and unless NYS allows blood testing at crash scenes this will continue. If an drug impaired driver is able to take advantage of the chaos and manipulate the police at the scene, as in this case, then this will continue and there is not a thing you can do about it. Without a blood sample there isn't any foolproof evidence of impairment after the fact. Of course the driver looks emotionally distraught at a horrific crash scene. It is very hard to distinguish drug usage from emotion in such a situation. In our case the drug impaired driver was able to hide his Vicadin and Pot usage behind a claim of low blood sugar,(is he a diabetic? Who knows?)and with some quick thinking get a Snapple and a candy bar. No arrest, no blood test. He was given a Breath O lizer but that was not his high of choice the night he killed my son who was innocently walking on the sidewalk.
California allows blood samples to be taken at the scene of accidents. If you are innocent what harm is it? We must support the Nassau DA's office in their efforts to have this become a NYS law. Alcohol impaired drivers are able to be arrested at the scene because they can be tested and held accountable. As it stands right now Drug users are not tested and therefore go free. I have lost my son to such a situation and justice is so very difficult to achieve without blood evidence. It is wrong and should be changed for the good of all.

Thank you Kathleen, we appreciate your kind and caring words. This has been a nightmare of epic proportion. Everyday we live in this hell that has been created for us by the irresponsiblity of two drivers who simply had their own interests in mind and disregarded the laws of the road.
The irony is that the law continues to protect the DUI van driver's interests. What does that say to society?
The judge threw out the indictment (the only one of 98 put before him) because the driver passed the breath o lizer test and that information was not disclosed to the Grand Jury. The alcohol test was not in question, alcohol was not the issue, Vicodin and Pot were his drugs of choice that night. There was even some confusion as to very important actual facts of case on the courts end.
The drivers attorney had a field day discrediting the DA's office. Do not believe all that you read, most the article in 11/19 Newsday is the Defence Attorney's spin on the case, free advertisment is a benificial and effective marketing tool, one I too intend to facilitate.
The "disgruntled employee" he refers to has had more empathy for our family than the driver whos only interest is his own butt. He came forward out of conscience because he knows the truth, firsthand, of the drivers condition that night and he was tormented by what occured. But of course it is the defense attorney's position to discredit the witness, anything or anyone else that may in the way of his clients vindication, at any cost, that is what he is paid to do. You were in the court room when he gave the two thumbs up to his client right in front of us, Charlie's family, how disrespectful and inappropriate. As if he were at a sporting event! Don't let all that education fool you, it's still just a used car salesman's mentality)no offence intended to the well intentioned and decent used car salesmen out there).
We will continue to fight for our son until every avenue has been exhausted. We also intend to support the DA's efforts in passing a law for police to have the tool of taking blood samples at accident scenes. If this was in effect there would be irrefutable proof and justice for Charlie and many others would have been swift and sure .

Another innocent young man killed by a drunken driver yesterday, a 21yr. old med student home for Thanksgiving break to be with his family.
This drunken driver was still on probation from his last DWI in 2006!
What is it going to take people?
