Woman sues Tewksbury police over arrest posting on Web
Type Miriam Solimine's name into Google and the second thing that comes up is the Tewksbury Police Department's online arrest log.

Does Ms Solimine live with or know the Kennedy family from Billerica?? Better yet, does she have the same Lawyer??

I read the article, I don't see where she's seeking damages. But by the press picking up the story she really has made her problem worse. It's tough to over come public ridicule, any given day here proves that.
Maybe someone will read the story and take the time to get to know her, then maybe they'll offer her job. Employers far to often are rushed through the hiring process and after reading a person's background already have preconceived notions about that person. You can't fault the employers for this, but also some people fall between the cracks. If she's suing for a winfall, I hope she falls on her face. If she just is looking for a break and trying to improve her life and move past her difficulties I wish the best for her. |

Any employer who runs a CORI check, which almost all do, will see her trespassing charge anyways. So I do not see how it would it would effect her more than it already has in terms of employment. I understand she is probably embarrassed that anyone who searches her name will find that police report, but I do not see what her gripe is.

If you are arrested in tewksbury, and found not guilty, your name still appears when you "google" it as you were arrested...does that seem fair?
Does it seem fair that Tewksbury PD lists your d/o/b and address? . and I can say first hand ...it does impair a first impression ...I strongly suggest Tewksbury PD amends their practices or the next situation may not go in their favor |

Arrest logs are public record, so are convictions. You can find anyone's age and address on www.whitepages.com . That information is listed so that the public knows what the person was charged with and it's in the interest of public safety. I'm pretty sure if your neighbor got arrested for distribution of heroin, you would want to know...

I thought when you have the charges dropped it will not come up on a cori report. She had said that the charges were dropped. I do agree with the person that if she was arrested she would have the problem in the first place. |

This could have all been avioded had Tewkbury police department handled this in the appropriate manner. There was a missing person report filed for her in Andover and Andover Police Dept asked Tewksbury to pick her up under protective custody when they had located her due to these circumstances. Tewksbury police department refused and unfortunately now this situation. Its an unfortunate situation and probably should have never happened.

THAT is what is most likely what puts her in bad light with employers. Still, she was arrested for trespassing; does she deny that she refused to leave a public establishment when asked? Probably not. So, how has the TPD done wrong here? Dismissal of charges does not exactly mean that the police were wrong to arrest you. Or, even that you are innocent. Overlooking the arrest log, I see a woman who is pointing the finger at EVERYONE else when things go wrong for her. At the hotel, it was the clerk fault that her credit cards were not accepted; now, it is TPD's fault that she cannot get a job. |

Maybe the officers could have been a little more understanding, Someone who was there, to her situation. Obviously there was more going on here than meets the eye...

Im pretty sure the CORI includes all arrests, regardless of whether or not you were convincted. So I think that even though the charges were dropped, they would still show up on your CORI report. You all want to be "tough on crime"...so yes, even if you arent convicted of a crime, your employer will still know you were arrested for one.

There are different levels of CORI access granted by the CHSB to different types of requestors. Fox example, the general public can make a request and see this type of info:
It is lawful to request this agency to provide a copy of another person’s publicly accessible adult conviction record. For the adult conviction record to be “publicly accessible” the person whose record is requested must have been convicted of a crime punishable by a sentence of five years or more, or has been convicted of any crime and sentenced to any term of imprisonment, and at the time of the request: 1. is serving a sentence of probation or incarceration, or is under the custody of the parole board; or 2. having been convicted of a misdemeanor, has been released from all custody or supervision not more than one year; or 3. having been convicted felony, has been released from all custody or supervision for not more than two years; or 4. having been sentenced to the custody of the department of correction, has finally been discharged therefrom, either having been denied release on parole or having been returned to penal custody for violating parole for not more than three years. Criminal Justice Agencies can see every incident that resulted in any type of contact with a Probation Department, including "sealed" cases. Only a judicial order to expunge will remove an event completely, and those are rare, and usually limited to cases where identity theft resulted in a criminal record being attached to an innocent person by means of the criminal using the identification of the innocent person. This is increasingly rare as CORI records are now generally supported by fingerprints (but not all misdemeanors are getting printed by local PD's). If you work at, or have contact at, a school, there is yet another level of CORI access that is granted. So, most employers will not see an applicants misdemeanor arrest if they request a CORI check. However, MGL 41, Section 98F, requires the keeping of a public log of arrests. Those logs can haunt an arrestee for a long time, as they do not show the disposition of the charges. As for protective custody, that is really a technical condition. For Police to put someone in protective custody (MGL 111b), that person has to meet certain criteria. In really short form, they must be under the influence of alcohol and a danger to themselves or others. MGL 123 Section 12 allows for protective custody of persons the Police believe to be a danger to themselves or others by mental illness. So, if the woman was mentally ill, but being merely obstinate that she would not leave, but not dangerous, the only alternative the Police had to legally remove her was to use an arrest for trespass. Any type of custody requires lawful authority. SO, it is what it is. It seems far safer for arrests to be a matter of public record than for arrests to become "secret," the public inspection helps keep accountability in the process. |

I'm surprised that a UCONN graduate could be so rude and act so uneducated... especially around mental illness. Many people have a family member or a friend that has struggled at some point in life with mental illness. But with an attitude like yours, you may not have any family or friends. Not sure? If the cops where responding to a missing persons call and she was arrested for trespassing, it seems that the entire story was not printed? Or it was a misunderstanding? My heart goes out to her and her family. |

UConn ALum is right. That lady sounds like she's a few cards short of a full deck. She shouldn't even worry about getting a job. Just sit home and collect your crazy check from the state. Imagine working with someone like that. I would make sure my desk is next to the emergency exit in case she comes in some day with a pistol and starts firing.

Thank you for your kind words, I guess its hard for other people to understand if they haven't had a family member or friend that has been through a similar situation. You are correct that this was only one side of the story, were talking about a highly educated woman that was "Athlete of the year", on homecoming court, college educated and has held many high level positions. These things do happen but I feel people should know that she is a very well intentioned human being that would never hurt anyone and was simply trying to clear up her record and move on.
