Hard to miss the part about the driver who hit her being unlicenced. Read again. If she had not been driving as the law would not allow her to, maybe this event would have happened much differently or not at all.

No licence, no excuse.

Sounds like there were a lot of safety issues to be addressed. And unfortunately not everyone can afford the price of a helmet, which is why many cities have programs to provide them to low income families. I don't know whether San Jose had such a program prior to this incident.

Maybe if you cant afford a helmet you shouldn't buy a bicycle. Although, I believe that the school should always try to make it a safe enviornment as possible, children are ultimately the parents responsibility.

These parents have to assume responsibility for not putting a helmet on their daughter, or for allowing her to ride a bike without one, whether they can afford it or not.

how are you going to sue the same school and district that has only good intensions for you and your child.i mean your getting a free education and yes a horrible incident did take place but its everyone's fault,the cities the schools and the PARENTS......my point is dont try to bite the hand that feeds you plz.
