A Roosevelt County man charged with shooting an eastern New Mexico farmer in 2005 as part of a murder-for-hire drug deal has pleaded guilty in exchange for a life sentence, avoiding the death penalty.

I read in this paper that we did away with the death penalty. Did no one inform this guy?

The death penalty was repealed and the Governor signed it out of law in mid March, 2009. I guess this prosecutor and the defense lawyer do not keep up on current law changes in our state.
Since they offered him life in prison against a penalty that does not exist, did they automatically give this guy an out? Ban faith negotiating? A really sharp defense lawyer could probably make something of this.

The death penalty can be still used on an eligible crime that was committed before the law was signed into effect
