Geez...you know, whether you're deaf, blind, or just incapable of achieving rational thought, just park the damn car and go inside. It's not difficult. Seriously, you park, you open your door, you WALK in the to place, you order, you go back, you open your door, and drive away. Just unbelievable.

i think this is the 2nd stupidest lawsuits against mcdonalds, the first is the lady who sued them because her coffee was hot.

If she's so hearing-impaired that she even order at a drive thru-window....why is she driving a car? I certainly don't want her next to me in traffic....

I agree with W Shakespear "first we kill off all the lawyers". This would solve the problem with our overburdend court system, and would eliminate alot of the useless politicians running our governments into the ground.

Acutally, many McDonald's have display screen that show your order - line item by line item, including what's ordered and what the price - as well as total/net amount due is. So, if she's not deaf and blind {and one can assume the latter since she's driving}, if they don't get her order right, she could tell them where the mistake is while at the drive-up window.
This sounds like a 'the world owes me whatever I demand because I've got it rough' sort of person, with an obviously shyster-lawyer as well. Bytch slap her, disbar the attorney and make HIM pay the court costs!

Please investigate the facts surrounding the Stella Liebeck case against McDonald's. It was a valid claim wherein she suffered third degree burns over 20% of her body, spent 19 days in the burn unit and required debridement.

There were over 60 small claims suits against McDonald's in the previous year regarding people, young and old, being burned by their drinks served too hot. Ms. Liebeck even tried to settle with McDonald's for just her medical bills, yet they refused. Ms. Liebeck and her attorney did not sue for such an exorbitant amount, a jury awarded it to her.

Before you spout your hate, get the facts.

Ok, please this is the dumbest thing I have heard next to seatless train cars.....If you can't hear why are you driving??? How do you hear emergency vehicles?

I have been to that McDonald's and it has the fastest, most convienent ordering process - letting someone order at the window would ruin the whole setup for "fast food"

Everyone knows if you do that you are bound to squeeze your legs together and spill. Can I sue 7-eleven for spilling my slurpee in my lap and suffering frostbite?

this case is crazy! Sounds like someone is shopping for a payday. I hope it gets thrown out - and she has to pay the legal bills. maybe she should also sue itunes becuase she can't listen to the music.

ADA essentially says ‘reasonable accommodation.’ McDonald’s is being unreasonable to not let her pull forward and then order at the payment window. It may violate some McDonald’s policyor it may mess up their drive-thru ‘rhythm,’ but from an ADA standpoint she originally asked for a VERY reasonable accommodation.

You don't need to be able to hear whilst ordering at a drive thru; you need to be able to speak--which this woman can do--at least to lawyers. So where's the beef?

Stella may be holier than thou but she is also shortsighted.
As Come ON correctly points out, an adult who places a hot beverage in his or her lap risks a very foreseeable burn injury. The lady that sued was an idiot and the jury that awarded damages were just as stupid.
That, ladies and gentlemen, sums up america's pathetic civil justice system. If the defendant is a big corporation, then find a shyster, sue and hope you find 12 unemployed derelicts to give you money you do not deserve.
Personally, I think this lady should have been able to order from her car at the drive-thru window. It is possible the young person who helped her was not able to make this call.
She should have contacted the restaurant and tried to work something out. I suspect she just ran to a sue happy lawyer who saw the proverbial "deep pockets."
Here is another point. I suspect Ms. Hearing Impaired had ordered food before in drive-thru's. I wonder how many fast food establishments she had driven through before she found one that refused service? In fact, lawyers have been known to pay potential plaintiffs to go out to restaurants and other business to that might have ADA violations, pretend to be a customer and then sue them.
This happens when there are too many lawyers and too many people looking for a quick buck.
I hope they fight this worthless case to the end so the lady and her maggot attorney don't get a dime.

ever notice those big flashing lights on top of emergency vehicles? one's hearing is COMPLETELY irrelevant to one's driving abilities. Most deaf people are highly visually alert as it is, therefore they do not need to be able to hear an emergency vehicle to know one is around.

also, in the case of the drive-thru, it is virtually impossible for a deaf person to use even if they use their voice - what if the worker says, "can you repeat that?" or "we're all out of cheseburgers, order something else." the deaf person would be unaware that these things are being said. in order for mcdonald's to properly serve her, the woman needs to SEE the employee she is interacting with so she can read his/her lips or write down her order and hand it to him. pulling up to the window is not not a big deal!! She should not have to go to inside if she wants to use the drive-through.

Stop calling her a fatass - you don't know her or understand her circumstances!! Stop hiding behind the anonymity of the internet - would you say these things to this woman's face?

this woman WILL win her case.

I have read other reports where she has gone to two other McD restaurants and got service thru the drive thru and that she has had problems on other occasions with this specific restaurant. Her issue should be with the individual franchise, not the whole chain. Corporate just has more money.
And if that is the case, if you know that you will get lousy service at one particular place, why go back and give them sales?

Though I do think the restaurant could have just stopped wasting time and taken the stupid order, I think she was not wise to go where she knew she would have an issue. It will be interesting to see when/if this goes to trial.
