Let alone the "Japanese legal system", just analyze the "victims" of the "break-up/divorce Chris-style":

CHRISTOPHER= lost the convenience of seeing the children 2 weekends a month in his own neighborhood. But he can still see them in Japan if he wants to. He has the money and time to do that. He's rarely seen them for the past 4 years anyway!

Education will be slagged behind their peers; social and psychological developments will be out of synch with their peers. The feelings of an outsider are with them for the rest of their life. I would amend to the last statement:
His second priority is his own selfish convenience disregard to the true needs of his own chidren whom he claims of dying love. And THIRD priority is to punish Noriko to the extreme with every possible venues: from social imprisonment to psychological bombardments with the help of the home-wrecker Amy and company!

I doubt it, because they would have to prove a prima facie case for that intentional tort and the standard for intentional infliction of emotional distress is pretty high; one needs to prove the actual damage and the case would have to be filed in TN, where the tort allegedly took place since Japan does not have a long arm statute. Very unlikely she would try to go to a TN court for relief and face arrest for her crimes! And a TN judge would laugh a lawyer who takes her on out of court if he/she showed up without Noriko under these circumstances. And she would immediately be counter-sued.

On the other hand, since Noriko has been indicted with kidnapping and since her friends claim in the press that she did it with forethought(that she felt trapped", I think that the former husband could easily bring an action against his ex-wife (for himself and on behalf of his children) for breach of contract, false imprisonment, outrageous conduct, intentional infliction of emotional distress, loss of consortium, fraud, negligent misrepresentation, and numerous other causes of action. Many of these would also be enforceable in Japan, especially the breach of contract claims. Japan does not enforce foreign court awards of punitive damages as a matter of social policy but compensatory damages in such a case could be very high indeed. Savoie could also bring the breach suit directly to a Japanese court to get part of his divorce settlement money back. That's what I would do if I were him because enforcement of foreign court orders have to go through the Hague system, take longer and are not as sure a bet.
