He should have begged Noriko to drop her complaint against him. If she does so before indictment, the charges against him will be automatically dropped per article 229 of Japanese Penal Code. Noriko may not want the father of her children in jail. Maybe she would get some deal for dropping her complaint.

This is possible since the charges against him is kidnapping of minor. If the charges were cross boarder kidnapping, the charges will not be dropped even if she drops her complaint.

He wanted to take the children out of Japan. He is under suspicion of "kidnapping for the purpose of transporting the kidnapped person to a foreign country" (Article 226(1) of the Penal Code). The prosecutors will not drop this case.

Shannon Higgins is a man. He has been featured in several ch. 5 pieces realted to this case. As reported yesterday, if Mr. Savoie had been in touch with the State Dept. prior to his actions in Japan how might this change the outcome? I wonder now if Mr. Savoie had "friends in high places" in the US g'ment.

I think the difference between what his ex-wife did and what he did is the fact that he took the children by force. The kids may/may not have been bruised, the mother may/may not have been bruised but regardless, its FOUR or FIVE adults against ONE adult. Injury or not, that scene could not have been pleasant for the children.

I am against any situation where a non-custodial parent is kept from interracting w/their children without cause. I cannot say in this particular situation whether there is cause or not. I'm leaning towards believing that Savoie took advantage of US laws in order to benefit from the divorce. He doesn't have much credibility with me so far, but I dont know enough about the situation or his ex-wife's thoughts to say who's better deserving. Again, because Japan is where the children lived and because Savoie uprooted EVERYone, including making it difficult for the children to stay in touch w/their mother's family, I'm leaning toward being more understanding to the mother's actions.

I've been through a nasty domestic violence divorce. My ex was constantly awarded visitation despite all the things he's done, even to her. Lucky for us, he only used the visitation as a ploy and had no interest in continuing those obligations for more than 2 or 3 months. Over the years though, its made a negative impact on our daughter and I regret now that I followed the judge's orders. I should've kept him away from her. She healed from the bruises, yelling, etc. But the fact that he'd pretend to care for her for a few weeks then just not show up for years, is what she has the hardest time coping with.

Its not that I didn't gather evidence, timelines and patterns of behavior, counseling reports, hire a VERY expensive lawyer who specialized in child abuse cases, etc. The judge still felt that he had a right to see his child. Even with all that, I wish I had not followed the judge's orders.

So, given my own experience, I'm not sure that these children's mother didn't do what's in the children's best interest.

OK, Shannon is a guy...Oh, I think I've seen his interview somewhere at CNN? Well, I wonder why US g'ment could not come up with a better advice to Chris Savoie. Hope that it was not, "Son, Just go & grab them with your pals!"

THIS WHOLE THINGS IS SO STUPID AND IT'S WRONG FOR WHAT THE EX-WIFE DID AND IT'S WRONG FOR WHAT THE FATHER DID. EITHER WAY THEY ARE BOTH GUILTY OF THIS SITAUTION. THESE KIDS DON'T NEED TO SEE WHAT'S GOING ON WITH BOTH OF THEIR PARENTS. THEY ALL NEED TO WORK ON THEN THINGS WITH THEIR CHILDREN. LIKE TAKE TURN WHO GET THE CHILDREN.

I have a hard time believing the State Department supported him in his plan and I'm not at all surprised that Japanese prosecutors are taking this seriously. Whether his actions are justified or not, Japan does not have habeas corpus within their legal system. They can and do hold people without charging them for far longer than the U.S. legal system so the prosecution can build a case. It reflects their cultural value that the interests of the group outweigh the interests of the individual.
For a super-smart man like Christopher Savoie, he sure acted stupid. I only visited Japan for a month and I could have told him this stunt was ill-advised.

This case involves violence and possibility of him fleeing country. I don't think they would want to release him. They shouldn't rationalize this. This is a normal police procedure.

Amy really needs to hash up. Look at Noriko. You don't have to speak every time they turn the microphone to you! Police wouldn't release an individual just because it's his child's birthday.

I agree he's attempting to take advantage of the US legal system to get things the way he wants them to be. He should have made more honorable choices in dealing with his wife, Noriko, instead of tricking her into believing they would move here to try to improve the marriage. He is a cad and needs to remember that his wife is a human being too and he can't make the laws change to fit his wants. The laws are supposed to be fair to everyone. Even wives you are trying to get rid of while keeping her children. Shame on him for both the actions wrongfully taken against his wife, Noriko, and for pulling this kidnapping stunt. Now he has to pay the proverbial piper. Too bad for him!

Trying to manipulate Japan and US legal system has backfired?

Of course, Japanese prosecutor has difficult time because Mr. Savoie used his American citizenship card while in the eye of Japan (where this event occurred) he and his children are Japanese.

Then the US state department had to be involved because the US media and his supporters treat him that he is American. Technically, that's true too. But by taking both countries' systems which are not strictly enforced in his advantage, he made this legal mess, and as a result, he himself prolonged his detention.

Now, the US cannot be very strong telling Japan that he is American because the US doesn't really encourage dual citizenship. This is the similar issue for Japan too. Because Japan does not recognize dual citizenship, it doesn't want to let the case go easily claiming Mr. Savoie is also American citizen.

Christopher Savoie actually got first received custody of his kids in USA before Japan then Japan should respect USA first as they already gave him by court that he got sole custody. Hope Japan realize that Chris already had from court in usa which he did act first before her or japan...

She does seem to exploit all of the minor children in this case. My wife would never put our children out there like that. Children are supposed to be protected by the adults in their life, why doesn't she get it? It's almost an obsession, it seems, to see who will get the prize. The prize is the Savoie children. He's a Japanese citizen who knew Japanese law and knew what he was doing was illegal in Japan - that's why he ran to the US embassy to try to be on US soil. His kids are Japanese citizens and lived in Japan all their lives except for the past year. He lived in Japan for 14 years with his Japanese wife, until he moved back to the US in 2008 to divorce his wife and marry his mistress. This is not an international incident. He's not even divorced from his Japanese wife under Japanese law since he didn't file paperwork there. He didn't file paperwork to get custody there either, just tried to snatch them off the street. It's clear that was wrong and a huge risk to those kids.
