I want to know who signed her consent form ?!? and why aren't they named in the lawsuit ?

There is no expectation of safety on this thing... people have died before doing it..... So basically if that wind would have not burst like that this would have never had happened....? If so then how is the boat captain negligent ? But someone needs to be the fall guy and since Jesus is not around to take the wrap for this we will settle for the captain... he should have known a gust of wind was gonna pop up and snap a steel cable.... silly him...

When people die at Disney I dont see anyone being criminally charged so why here ?

THUS GUY HAD TO BE QUALIFED TO OPERATE THAT BOAT,ANd its not Like a FISHING BOAT,IT TAKES A LITTLE SKILL TO MANUEVER THAT VESSEL at the SPeed it Travels,IT WAS AN UNFORTUNATE ACCIDENT,NOT INTENDED..........Geeeeeezzzzz zzzzzzzz IM SURE YOU MUST SIGN A WAIVER........And thats Like Saying a PILOT OF A PLANE IS NEGLIGENT IF A PARACHUTIST DIES......

Wow, thank you for some decent comments by people who actually know what they're talking about. To have 7 years in the business, in year round warm weather, Kipp must have had thousands of flights with no accidents in the past. As unfortunate as this has been, accidents do happen and can't be seen coming. You think the 14 year old girl that's legs were taken off at on the raptor saw it coming, yet that operator was never punished, the theme park maybe for maitentance. OR how about the women that died within the year at a northern amusemnt park, yet again an unfortunate accident not being operator error. Don't place all the blame on kipp, accidents happen in parasailing, I've seen winds actually pick up the rear end of a 30 foot boat weighing tons... those line are supposed to support up to 10,000 lbs of pressure, and on a normal wind day, which kipp took off in, with two young girls, even reaching parasailing "limits" of 20 mph winds, the pressure should have only been about 800 lbs... accidents happen, don't look to blame for the sake of putting it on one person

those are the 3 smartest commenters ive ever heard here. thank you for speaking rationally and reasonably. this time its really the thought that counts.
its true that this was an unexpected accident. most likely because of the media and a few coin seekers, it will escalate into something it shouldnt. i still dont remember them saying who forced this poor girl on this ride. unfortunately bad things do happen to good kids. where were the parents is a question im always asking. dont we still supervise our kids or do we just let them do anything?

Frivilous lawsuit and a witch hunt. News flash for the parents--punishing the boat operator will not bring that girl back. She is being dishonored by what appears to be a quick grab at the jackpot.

Anytime someone puts themselves in a situation that involves tremendous heights and exposure to the elements, risk of bodily injury is involved.

To blame the boat operator on a gust of wind and a broken rope is ridiculous. The weather in Florida, like anyplace else, can change rapidly, and thunderstorm warnings are an everyday event.

This captain most likely required a six passenger license for operators of un-inspected vessels. Unfortunately I don't think the piece of paper which represents the passing of a written test would have made any difference. It appears that use of common sense would have. If inclement weather conditions were imminent then it might have made good sense to wait it out or postpone the trip for a better time.

He would be neglient if he allowed a minor to participate with out parental concent. These girls were underage and not accompanied by a LEGAL guardian.

Sorry...but it's a lot more complicated than you are trying to make it out to appear. Your big emphasis on "common sense" and "good sense" just doesn't hold any water in such cases (no pun intended). The one most major thing that cannot be ignored is the fact that because it is so crucial a life-saving service is provided to all boaters on the current weather conditions and the captain claims he did not get the latest warning alert that went out a half hour before he made the boat sea-going. Excuse me!!!

I have worked with vessels for years...

and the one thing everyone knows before going offshore is to check the weather... from a realiable source....all he had to do was turn on his VHF.

This is where this captain has failed... End of Story!

and not to look up at the sky and say...it doesn'tlook like rain

The Capt. or the Parents? I'm sure there is more to it then the One Sided Sun-Sential is saying.Weather, Faulty Equipment,Lack of training just to name a few, and there is probably a lot more.Time will tell as long as the sun sential doesn't sweep it under the carpet

I actually had a degree of compassion before I watched the video that accompanies the article. If ever I have seen a shameless grab for cash and notoriety, this was it. Between the sobbing mother (why was she on screen if she was not going to answer questions?) and the slimeball attorney, my stomach turned. And of course, they had a slide show going on in the background of the two girls, demonstrating their injuries. The only thing missing was having Amber's casket onstage with them.

Sorry, Ms. Krauss, but standing on your daughter's dead body shouldn't give you enough lift to grab the gold ring.

SUE,SUE,SUE, It's all about the money. Terrible accidents happen everyday, but when there's $MONEY$ to be made someone has to pay! Now this Lawyer see's 3 sources,Boat Captain, Water sports concession and Hotel(Timeshare resort).

It CAN get very, very complicated if you include a bunch of completely irrelevant maritime babble. Why not throw in trivia about the Andrea Doria and Titanic? Three miles out? Two hundred miles out??? Whales?? If any of those were the case I don't think anyone would have hit any buildings. Are you just trying to manufacture (badly) an opportunity to show how much you know about maritime law (not that much it seems)? Or are you truly oblivious to the matter being discussed?

This accident, and the keyword being accident, is a real sad event. I can only pray that Amber's Sister and mother can get over such a tragic loss.
That being said, what is it you expect from the operator of such a thrill seeking event? You would expect them to be:
1. Properly trained in the operation, and condition of their equipment.
2. Properly licensed
3. Take measures to insure the safety of the riders.
4. Inform the riders of all risk's, involved.
5. Get signed waivers from riders, and/or guardians if the riders are under age.
Is Ms.Krauss entitled to compensation for the loss of Amber? ABSOLUTALY! But not through a witch hunt that has the potential to ruin another life.(That of the young Captain)
Go after the insurance company, and stop the DRAMA.
I will continue to pray for you all.
