The title makes me think "what a load of crap" but when you read the article, he elbowed her in the mouth. Which I can see the domestic battery charge. I understand he'd also be guilty of the same for the water, which I think is ridiculous to file a charge on. And yes, I know it's a legal charge to do so is she wanted to file because of the water. If wonder if he could have filed for abuse because the smoking endangers his life?

Well, its not like he got a shovel and beat her to death or punched her out. This is not domestic battery, it just isn't. If he told her not to smoke in the house and she did it anyway she needed to be taught that rules are rules.

This is like the urban legend surrounding Sir Walter Raleigh. The story says that he was smoking tobacco, perhaps a pipe, and one of his servants thought he was on fire and doused him with a bucket of water. The incident really didn't happen, but it made its way into history books and schools. Speaking of odd history, it was funny what happened in the colonial days in North Carolina, and a teacher I had claimed to be related to someone involved. What happened was sometime in the 1600's or 1700's during all the violence and unrest of the colonial days, the newpaper office was broken into and vandalized. The newspaper was called the Halifax Compiler. Well, the vandals rearranged the type set and change the letter. So the next day when the paper was run, the name of the paper was the Hellfire Compilax.

It was the elbow to her jaw that got him in trouble.

It is her house also. If it really bothers him she should designate an area where the smoke doesn't bother him. More than likely they were drinking.

He can you know, here in Canada if anyone intentionally blows smoke in your face, etc, you can charge them with assault. I would and will.
