Divorce...if spouse wasnt served or notified at all. is divorce legal?

if you didn't sign any papers and never knew nothing about it then you are still married legally. Sorry but that is the truth.

No that is not true, back in the older days if they TRIED to reach you 3 times, once by mail, then certified and sheriff, then you got it. I did minE.

Also, if you were in jail at the time they got it, then it is def legal. it is true 3rd time is a charm. lol

but who in their right mind would avoid it??? 9 times outta 10 most ppl would sign away IF THEY KNEW anything about it. I'm sure there is no possible way someone could avoid it. They would def know something about it and im sure they would be more than happy to sign them. Something isn't adding up here.

you can't now days. you have to be served and then it has to be signed..You must request in writing a hearing by telephone at least if you are unable to attend anything. there has to be actual service of some kind, so if he can't be personally served, he/she need to be served by another method.

if the two spouses move away from one another and they no longer talk to any friends/family etc and they have no location, all they can do is send to the last known address and hope that it gets forwarded or someone who lives there knows where they are.

They have so many days to respond to that. Then if you still don't respond, the person filing for divorce can file another paper asking the judge to grant it anyway. You will then have to wait another waiting period.

I am not an attorney but to the best of my knowledge they cannot make you stay married to any one.

Yes this is how it is, I just got my divorce this way my ex refused to go sign for the papers at the post office so I got my any way. lol

Well they can now..my friend has been trying to get one and the lady wont get the ail, answer the door for the sheriff, or get the certified mail out, and the man had to get another lawyer hisself to fill in for the lady that wont sign the papers..his first lawyer costed him 400, and then he had to hire one for his ex for 300 and then she won't have to be there..he has been trying for over a yr to get her to do it, she wont. so charlie is still in a pickle

YES! It's legal to get a divorce even though the other party was not notified but several attempts have to be made by the representing Attorney, such as mailing the divorce decree to last known address, contacting family members, and of course a summons attempt to be served by Sheriffs Dept. If attempts have been made then your attorney files a Warning Order Attorney with the court on your behalf showing the Judge that either the person is evading to be served or is no where to be located then the Judge will grant a divorce. If a person cannot be found, a warning order attorney is appointed by the court to attempt to contact them. A divorce can be granted that way
