Raped Jacksonville jail worker files intent to sue

A correctional officer raped at knifepoint by an inmate at the Duval County jail notified the Sheriff’s Office this morning that she intends to sue the department for failing to follow its own policies procedures designed to protect her.

The woman, who isn’t being named because she is a sex-crime victim, said the Sheriff’s Office relaxed security precautions on Jonathan Tave, the inmate who raped her in the jail law library. Tave, 26, has since pleaded guilty to the rape and a murder and was convicted at trial of another murder. He is serving life in prison.

The letter addressed to Sheriff John Rutherford says the jail also shouldn’t have allowed violent inmates to be alone with female employees and should have monitored areas of the jail like the library that weren’t under surveillance. She said the library door could only be locked and unlocked from the outside, preventing her escape when Tave attacked her with a homemade shank. And she had no alarm to summon help or protect herself, the letter says.

Under state law, the city has six months to respond before a lawsuit can be filed.

Cool, even more lay offs now. I can't wait. This is the reason why I will probably never see a raise again as long as I am with the Department of Corrections. Why can't some offender on probation rape me so I can file a lawsuit? That's it, I'm looking for anything I can around here to get paid. LOL I hope she gets a good settlement.

There is a statutory cap so, no, she won't get a "good" settlement. And no amount of money will repair the damage done to her by that savage.

Not a real big fan of the sue to win life’s lotto, but in this case suing the Sheriff’s Office is much founded. If it comes out that the Sheriff’s Office relaxed security precautions for one or more inmates those who made that decision should be fired, period! Sheriff John Rutherford must also be held responsible for one of his employees making such a bonehead call.

Now for the if, If this woman knew that the library was not under surveillance and that she had no alarm to summon help, then her judgment needs to also be questioned. The attack and rape where in no way her fault, yet this crime could have been avoided on so many levels.

I think this suit is not right. If you choose to work among violent criminals then you have rolled-the-dice from day-one. Surely you have no expectation of safety, any more than an officer on-da-beat!

That said -- shouldn't a violent criminal stay locked in a cage and be fed thru a slit once-a-day? Free access to an open-environed library? You must be kidding!

I've suggested this before --- tents & 10x10' barb-wire cages in the Utah desert....

The officer had gone to the higher ups multiple times about the safety and security in that area...her complaints were ignored, and ignored again.

It is stories like this that really piss me off, how much to you want to bet the higher ups are typical government workers who know they can not be fired and are only yes men or women. Hindsight what it is, maybe she should have filed a safety and security grievance and refused to work under those risk.

If this were not a government own operation it would already be out of business.

It's being debated because some people feel the necessity to get on a public thread and make glib little remarks about how "they should have been raped so they can get some money too." I promise you, if they had been, the money would hardly make up for it.

Look, Spunky, I sound the way I do because of how many of these types of stories we all hear about every day. I work in Corrections as well, and used to work at Florida State Prison, home of the worst of the worst. I do sympathise with the victim in this case and my comments were not to make light of her situation but to actually voice my disgust at the way things were handled that allowed this to happen. The jail's security measures need to be seriously re-evaluated and changes definitely need to be made to keep this from ever happening again. I am sorry you got the wrong impression.
