If you feel that there is a problem with water run off in the area, then you are the Man to get it fixed. There is a city ordinance in regards to this water run off issue. GO FOR IT and get it fixed. Please let me know what you find out as to this water run off issue. I am very curious.

And yes, I did know the dentist was unhappy with the situation and did the correct thing by taking the issue to court. I had not realized there had been a ruling. Good to know the system works.

Matt,
I went a reviewed Casenet and the Injunction cases out of Cole County for the Dr. Casenet does not have any information about the disposition. When you say the case has been ameliorated, I was wondering what you intended by that. It is my understanding that it means to make better or corrected? So, in this case, what does tha mean? Was the developer ordered to make the corrections I saw today being made? Also, where did you get that information if it was not posted on line? Is this inforamtion that is available to the public? I apologize if you misunderstood. There has been no ruling issued in the case, or if there has, I have not been made aware of it. What I said was that the road situation has been ameliorated (made better). As I understand it, the filing sought injunctive relief on 2 issues, 1. being the road (which now seems to be taken care of) and 2. the giant mound of dirt adjoining his property. I have not seen it today, but if they are working to remove the pile, I am happy to hear it. Just wanted to make sure I was crystal clear, as I know how certain folks love to attempt to try and spin my words. |

Matt, I you do not know if this has made its way through the court, then how can you say his filing for an injunction in the Cole County Court is what got it done? Either way, it was good to see the new road and the workers taking dirt and using it on the development site and removing some. At the speed they were working, I would expect it would take some time for the pile to be removed. However, if the pile is causing damage to the Dr's property, I do hope you will step up Matt and take action to protect the dentist. |

The road to the Dentist's is brand new asphalt. It is a lot better than before. I was there just last week to have some work done and was surprised by the new road. Of course, I think they had to do it because they were planning to destroy the old one for something.

I am sure you are right. They do have plans on what they are doing and they replaced the road because the plans called for it. I am also sure the dirt pile will go away when the plans call for it, unless Matt or someone else can show why it should be moved sooner. If water from this pile is causing problems at the dentist office, then it might happen. Looking at the situation yesterday, I am not sure how water could cause the dentist a problem. But if it is, I am sure Matt will address it. |

Actually, there are ordinances against "spoils piles" on sites that are not in use. The lot that surrounds the dentist is an out lot and not in use. That mound is way to high to be in compliance with the ordinance. And don't kid yourself. THF had every intent to build the Wall there and pile the dirt up in that EXACT spot so people couldn't see the office. It's morally wrong and karma will come back to get them for it. I'm sure the same idiots who did this vote Republican and go to church. Hypocrites!

There probably are ordinances against "spoils piles" in other communities, but I can find no such animal in City of Arnold codes. There are some things that I know were there before, but am unable to locate now. Its also possible that there are state or federal regulations that apply, through maybe OSHA or DNR.
