Prop. 8 Challenge Filed in Federal Court

In a bold move that takes a new approach to achieving marriage equality, two attorneys who argued opposing sides of the 2000 Bush v. Gore lawsuit before the U.S. Supreme Court have filed a challenge to Proposition 8 in federal court, The Advocate has learned.

Theodore B. Olson, the U.S. solicitor general from 2001 to 2004 under President George W. Bush, and David Boies, a high-profile trial lawyer who argued on behalf of former vice president Al Gore, filed the suit May 22 in U.S. district court on behalf of two California gay couples.

The attorneys argue that relegating same-sex couples to domestic partnerships instead of granting them full marriage rights is a violation of the equal protection and due process clauses of the Fourteenth Amendment to the U.S. Constitution.

Olson said he was contacted several months ago by representatives of an association called the American Foundation for Equal Rights about his willingness to represent the two couples named in the suit.

“For a long time I’ve personally felt that we are doing a grave injustice for people throughout this country by denying equality to gay and lesbian individuals,” Olson said in an interview with The Advocate.“The individuals that we represent and will be representing in this case feel they’re being denied their rights. And they’re entitled to have a court vindicate those rights.”

When pressed about his service with the Bush administration, which in 2004 endorsed an amendment to the U.S. constitution that would prohibit same-sex marriage, Olson said he was personally against the amendment at the time, though he made no public statements on the matter.

As for the timing of the suit, Olson said that recent decisions by the U.S. Supreme Court “make it clear that individuals are entitled to be treated equally under the Constitution. I’m reasonably confident that this is the right time for these [injustices] to be vindicated.”

Olson, Boies, and other attorneys working on the suit are being compensated by the American Foundation for Equal Rights, Olson said his law firm and others also are contributing resources pro bono. As of press time, no website could be found for the newly formed organization. Olson and his representatives declined to specify who was funding the campaign.

The plaintiffs in the suit are Kristin Perry and Sandra Stier of Berkeley, Calif., and Paul Katami and Jeffrey Zarrillo of Burbank, Calif. Perry is executive director of First 5 California, a state health and education agency.

It will never be over until we become anything less than second class citizens. Get used to hearing about it, because it will continue to move forward.

If we relied on a majority vote like we did for this proposition (which did not pass by much), then blacks would still be slaves, women would never vote, and there would be no interracial marriages.

If we rely on a majority vote for everything, this country will cease being a democratic country and would become a theocratic country rivaling the Taliban. It would be a Christian Taliban country.

Jesus NEVER went to Pontius Pilate to insist the local laws were changed to benefit his followers. Jesus never attempted to FORCE people to adhere to his beliefs through the laws of the land. Jesus NEVER commanded or forced people to do anything. It is all by choice! The freedom of choice!

Christians are not about choice! They are about forcing and imposing their will by changing laws that benefit them and them only. They are about legalizing morality at the price of other's freedom. Choice has been eliminated.

Are you sure you are speaking on behalf of your god in FORCING his laws onto fellow Americans that pay their taxes, support the community, serve in the military, and donate to help the needy?

Jesus lived and taught by example. If you are striving to be lilke Jesus, are you sure you are following in his footsteps and not for your own personal glory?

BTW, if any of you haters are capable of reading, you might be interested to know (not that you would understand) that yesterdays ruling said not one thing about gay marriage, gay rights, God, blah blah blah, but rather addressed the Calif. proposition process as it pertains to ease of revisions/amendments. It also did not address 'rights' but only rather only the use of the term marriage. In the mean time, thank you so much for starting the ball rolling as papers are already being filed in federal court as it pertains to Prop 8 and equal protection under the law. In the mean time, my GAY marriage remains legal and intact, just kills you doesn't it!

Yes the ruling is definitely a partial victory. California now has legally same sex couples.
Civil rights issues take time after time before the people realize what the right thing to do is. Education, education, and momentum. We wil prevail.

I posted this in another thread but feel it might be helpful to those who are attempting to understand why the mormons are expending so much energy to deny equal rights to gay citizens: "LindaS said "Mormons are only 1.3% of the U.S. population, less than gays. So why should they have more political clout? " The mormons are all required to turn over 10 % of their gross income to the church. This Church is a mega billion dollar financial political empire with absolutely no accountability. The Doctrine of the Church teaches of a theocracy to replace the United States Government. This theocracy once established will then resume blood atonement, and polygamy, two important parts of this patriarchal authoritarian church. The members are taught to lie to protect the church and will use really sneaky debate tactics to undermine the credibility of any who seek to expose the danger of this group. They are dangerous! This church has already put a disproportionate number of members in strategic positions of power in the FBI, CIA, Homeland Security, and of course their prophet already has dictatorial powers in Utah. All of this can be verified on the internet and other sources. You will have to wade through an incredible amount of disinformation generated by the church but after awhile their "scholars " are really easy to spot. The thing that is really troublesome currently is their efforts to subvert the constitution with their intense efforts to attack the minority group of gay citizens. If they succeed in this it is just a matter of time before they achieve their agenda of wacky theocracy. We all need to get informed and get involved in helping everyone to recognize the real danger of the false patriarchal religious military industrial complex. Apathy is a valuable tool of those who would sabotage democracy!

Is not recognizing the religious beliefs of others a display of intolerance? Who is being the dumb arse here?

Many believe that this collection of 66 books written by 40 authors who all had some sort of spiritual encounter is the inspired word of God. Jesus confirmed when He said "Thy word is truth." (John 17:17)

The second book of Timothy Chapter 3, verse 16 tells us that "All Scripture is inspired by God and is useful to teach us what is true and to make us realize what is wrong in our lives. It straightens us out and teaches us to do what is right."

I do believe in gay marriage, but last nights yelling and screaming on stage by the speakers did nothing to help your issue. In fact several of my gay friends left the rally because of that. If you are going to have a rally again please have speakers who can speak and not yell and scream, and who can give good information.
