The driver, identified as 21-year-old Kenneth John McNair of La Mirada, then sideswiped another car stopped at the light before crashing into a 2006 Peterbilt semi tractor and trailer. The drivers of the other two vehicles were not injured, police said. The victim was pronounced dead at 1:42 a.m. His name is being withheld pending identification and notification of his family. McNair was arrested on suspicion of felony driving under the influence and vehicular manslaughter. Police said the cause of the collision, however, remains under investigation and is asking anyone who might have seen the crash to contact Huntington Beach Police at

i saw this happen last saturday. there was nothing anyone could have done to save him, apart from mcnair not being an idiot. my prayers go out to jose's family and friends. i can only hope that this tragedy prevents other young people from making stupid mistakes.

kenneth is my cousin and he is a good guy. He made a very bad decision to drink and drive and will live with the guilt of what he has done for the rest of his life. stop saying nasty things about him and be more interested in your own lives.

I'm very sorry for what you're family is going through also, I can understand it is tough for everyone involved. However I really don't think anything that has been said here is really out of line if what is alleged is true. Most of the post were heart-felt good-byes to their friend in a public forum. And there exists a public interest that if the allegations are in fact true that the case is handled in a proper judicial manner as if these cases are let to slip by hush-hush we all would be more at danger by an explosion of more acts of unintentional indescretion. Once again, I am sorry Keri, I know it's tough, hang in there.

I saw Jose's car ablaze that night. I arrived at that intersection only to see 1 police car at the scene. It must have happened only a few minutes before my arrival. His car was a blazing inferno, with flames so intense I couldn't even identify what kind of car it was let alone determine if somebody was still trapped inside. I keep wondering whether or not Jose was still alive or conscious when the fire started. Such a senseless tragedy--and all because some reckless, drunken fool got behind the wheel. I can only hope Jose's death will serve as a serious wake up call to all those idiots out there who make the choice to get behind the wheel after they've been drinking. Kerri, you say your cousin was a good guy. Well, not anymore. He's a murderer now.

Amy, I just wanted to say thank you for putting up the shrine on the corner of where the accident happened. I was deeply saddened when I saw the shrine on my way to work 2 days later. It confirmed my worst fears. I pulled over and read the article you had posted and saw the picture of Jose. It made me very sad. He seemed like a good person. I'm so sorry you and the rest of Jose's friends had to lose him.

I think it's worth mentioning that Mr. McNair has an absolutely clean criminal record. This may be, probably is the first time he has ever been in jail at least in this state. BTW: I do agree, innocent til proven guilty. The cause of the accident is still under investigation, and there may be reasons totally unrelated to Mr McNair's BAC level that caused the accident, such as a problem with brakes, tire blow out. Police always book for the highest possible charge. A prelim hearing has not even been held yet, only an arraignment and that would have been held while he was in the cage before talking to his attorney for more than just a few moments. It's going to take a few months for all the facts come together. Every keep the faith and say a prayer in memory of Jose Pacheco. And also Kenneth McNair could use a prayer too!

man that guys a killa get over it people you drive drunk and most the time someone dies... I give my love to the family of JOSE and i never even met him. Everyone in this world just needs to take 3 steps back and work on r own lives instead of always worrying about others.. I know how it feels to lose a loved one at 8 years old i saw someone who was like my mom and someone who was like my sister get hit by a boat and the guy who was intoxicated got not a damn day in jail! so grown ups grow up and learn to take the resposibilty of beeing a adult.. its sad that a 16 year old has to say this... R.I.P JOSE...
give the guy jail time so he can think about what he did and maybe then he will no whats up..

i bet half the people that are reading this have drove drunk.....and u never think something can happen untill it happens to u.....accident is still under investigation, why did a mustang explode in 2 mins, and no one in the honda died?? ever think of that maybe he wouldnt have died if it wasnt a ford you should all research that the history of the mustang and the problem with the gas tank......i just want everyone to know...kenneth is a really great guy never been in jail in his whole life or been in trouble.....he is serving time now!!! kenneth also goes to college and has a great job, but one bad decision has changed all that for both families. my heart goes out to jose and his family, but 2 families have been ruined. trust me as i say this kenneth is hurt deepley and would have never intentinally killed sonmeone NEVER!!! it was a mistake...an accident, and i do hope that people do stop drinking and driving cause this could happen to anyone, and like i said it hurts everyone involved from both sides!!!!
