I would think it would not be too hard to determine Hecker's primary residence. Minnesota has a homestead credit law, which give the homeowner a break on his primary residence. A quick check of the records would reveal which home he claimed as his primary home. That then would be the basis for the answer to the question. Now if each home was listed in his wife's name only and the other in his name, it still should not create any confusion. Again a quick check of those property tax records should be all the bankruptcy court would need.

Deputy arrived and found a verbal domestic did take place with no weapons involved or threats made. Male subject left residence before Deputy's arrival. While emoute, di spatch advised there was two children inside the res idence and the husband was outside attempting to get insidc. A short time later while I was still enroute, dispatch advised the husband, Dennis Hecker telephoned dispatch and advised dispatch he was currently in the Brainerd area and was not on the property any longer. Hecker stated he was not threatened by his wifc, Tamitba, and that he did not want Law En forcement to continue. Crosslake Officers Willard and Stanwood assisted me and we proceeded to the residence to speak with Tamitha. Upon arrival, the groundskeeper, Lohmiller also arrived and we spoke with him briefly in the driveway. Lohmiller stated that he had phone contact with Tamitha and that she requested he respond to the residence. Lobmiller also requested that he go inside the residence with officers because he is good friends with the Heckers. Lohmiller stated that when he spoke with Tamitha, he is certain that she did not have a firearm nor did she know of any firea.rms inside the residence. Lohmiller did go with officers inside the residence. Upon entering the residence, Lohmiller did speak with Tamitha and went to an upstairs bedroom. A short time later, Lohmiller walked downstairs with a ha.ndgun that was inside a zipper sty le case. Lohmiller stated he knew of the weapon inside the residence in the past, and that he found it to be in the same spot as it was last time he saw it. Lohmiller handed me the firearm and it was secured inside my patrol unit. Tal11itha denied knowing of the weapon nor the location where Lohmillcr fo und it. While speaking wi th Tamitha and her step-daughter, Holly, they both stated there was no weapons being used and that neither one of them knew of any weapons inside the residence. Tamitha stated that she believes a fema le who is a p3l1-time guest on the property, Michelle, telephoned the call in because Michelle has been harassing her lately. Tamitha stated Denni s, Hol ly and her did go out for dinner this evening and returned home. Tami tha stated later in the evening, Dennis became upset and was walking around the residence yel ling at Tamitha. Tamitha stated she was becoming afraid of Dermis because of his demeanor. Tamitha stated at one point, Dennis walked outside and into the garage, and once he did thi s, she locked the door and would not allow him to get back into the residence. Tamitha stated Dermis did not have any keys to get back inside and was ye ll ing at her to open the door. Tamitha stated that at one point, Dennis attempted entry inside the residence by using a screwdriver on the front door and the door to the garage, causing scratch marks to the metal door frame. |

Tami tha stated after Delmis was not allowed to gain entry, he did leave the res idence in a vehicle. Tamitha stated she then telephoned Lohmiller to dri ver to the residence, which Lohmiller di d. I explained to Tamitha the OFP process and she stated she understood. Tamitha stated she did not wish to pursue any criminal charges, but did wish to have a report of the incidence on fi le. Prior to leaving the residence, Tamitha stated she did not fee l comfo rtab le with a fi rearm inside the residence, and requested Lolml iller place the firearm in Ius safe, whi ch he did. I was able to make contact by telephone with Denni s who stated he was currently in the metro arca. Dennis stated that he was at the residence earlicr this evening and was about to have dinner. Dennis stated that he stepped outside to retrieve some chicken from the garage and upon returning to walk back inside the res idence, he found the door to be locked by Tamitha. Dennis stated that he was dcnied enteranee after several attempts to get back inside. Dennis stated while standing on the driveway, he looked up to the second fl oor where the master bedroom was, and noticed Tamitha standing in the window holding his handgun and was waving it back and fo rth. Dennis deni ed feeling threatened nor did Tamitha point the weapon at him, but he was concerned for the two minor children sti ll inside the residence. Delmis stated that the children inside the residence were near a window and were "taunting him" by showing their middle fin gers at him while laughing. Dennis stated he telephoned a freind for advise and he was advised to leave the res idence, which Dennis did. Dennis stated hc te lephoned the Crow Wing County Dispatch because he was concerned for the two children left in side the res idence. Dennis stated he did not wish to pursue any charges.
