Three teens charged in death

Check out www.jaygaither.com . looks like jay gaither made a huge misteak that made national news. Denver Post did several articles on the worst crimes that prosecutors have messed up. One of jay gaithers was the worst in America.

Jay Gaither doesn't set bail or give sentences. He is a prosecutor. Judges are the ones you need to complain about. Learn the system.

Old Elephant is right there are many reasons that have nothing to the work of our DA- such as the fact that crooks are crooks and crime happens, judges are overworked, but, Jay Gaither is the chief prosecutor and over the last 8 years he has never tried a case, is rarely seen at the courthouse and even rarer to be seen in a courtroom. When he was elected he replaced a DA who was rarely seen and rarely heard from. Seems like we are back to the same old same old and we are really paying for it.
A criminal in our area has a better chance of getting a slap on the wrist, a kick out of the courthouse door and then after the first "two" felonies the DA waits for them to re-offend and they end up with a habitual felon and then we can put them up for life. A wealthy well connected criminal has a great chance of getting lost in the system.
Our system is broken. Justice for a few, Criminals on the street for all...to wait and wonder when they will go through the revolving doors of justice again. Our system can't work with this DA.

Old Elephant and Justice for All... you apparently do not work within the Judicial System. I see dismissals and reductions every day ... by the office of the DA.. Who needs to set bail or give sentences when you have the authority to just throw the case out the window!?! Just today, "Careless and Reckless to Endanger"... reduced to Improper Equipment. HUH!

Insider-You mean the DA can make a case disappear? Insider-Please tell us more about how the DA office opearates- we are all wondering where do the cases go...being on the outside of the judicial system is confusing. What happens to all of the reported crimes in the local papers? i never hear about any trials or people going to jail? what about the victims?

A DA's office has the "authority" to reduce or dismiss cases before court, most of which are traffic related. It's up to "Assistant DA's" to make this decision and in most cases, the actual District Attorney never sees or speaks with these people. In Catawba County the DA's office has not only been a revolving door for repeat offenders, but for "Assistant" DA's as well! Judges can only hear and rule on cases if they are presented before them in court. If the DA's office has already dismissed a case or reduced it to a "payable" offense.... there's no reason for it to go before a judge. The defendant pays the fee and is off on his/her merry little way to speed or whatever, again....With Criminal cases, allot of those are "plea bargined" down to lesser offenses in order to prevent trial time...something Gaither or DA, has no personal experience with. Based on the conviction rate and blunder of trials,his Assistants have a track record for inability to present evidence or cross examine witnesses in order to actually win a case. It would appear that it's just easier to move the cases through rather than punish the crime...Unfortunately it's the victims and future victims who suffer, waiting years to see their case come to trial or see it screwed up during trial.
