I hope they prosecute the driver (his mother) to the full extent the law allows. It is your responsibility as a mother to make sure your child is buckled in safely when you drive. I was in an accident three years ago with my then 5 year old son, I did what I was supposed to and it saved his life. If she and her mother chose to not wear a seatbelt they can sign off on living, this poor little boy relied on someone else to make his choice.
