God bless this dear little boy's sweet soul! What a horrible end for his short life. My sympathy to those that knew and loved him. No why didn't they or what ifs. Living with this is something beyond what I can begin to imagine doing.

I hope they prosecute the driver (his mother) to the full extent the law allows. It is your responsibility as a mother to make sure your child is buckled in safely when you drive. I was in an accident three years ago with my then 5 year old son, I did what I was supposed to and it saved his life. If she and her mother chose to not wear a seatbelt they can sign off on living, this poor little boy relied on someone else to make his choice.

three generations in the car with no seatbelts... Sad but true darwinism

Why prosecute the driver now ? Wouldn't bring back the dear little 4 year old.

I think the driver just got a life sentence... losing her mother and now her beloved child is punishment enough!! EVERYONE have made mistakes in their lives and unfortunately hers had a tragic end!! If the world would be more loving and compassionate what a wonderful world it would be!! My prayers go out to the family!!

I agree. As if this woman isn't going to suffer enough. Maybe on top of it all we should give her a FINE and make her do TIME, huh? ABSURD!!

Everyone is always willing to dismiss charges when someone kills their own family in a car. Pity she wasn't DUI only then would anyone want her punished.

Yes, a FINE and TIME may make her think twice the next time she puts a child in a car without being buckled in. Of course maybe she should never be allowed to drive again so an incident like this tragedy will never happen again.

Have to disagree with you on this one. Shame of york hit the nail on the head. It was her responsibility to take care of her son. She failed miserably and yes, she will pay for it emotionally the rest of her life. But the fact remains, she took his young life unnecessarily.

My 4 year old son takes his seat belt off all the time. I have to yell at him and pull over to put it back on. She could have had the belt on and he took it off to pickup a toy from the floor (which is what my son does all the time).

Maybe this story will get other people to use seatbelts ... but then, maybe not. Some people are incapable of thinking.

@HyperU2 You hit the nail on the head, pity she wasn't DUI.If she was DUI everyone would be yelling for her head instead of felling sorry for her. Dui is a law, as is seat belts and child safety seats are also the law. Someone has a shot of Jack in them, it's lock them up and throw away the key, don't put the child in a safety seat ,it's take pity on them. Two people died ! Why? Because somebody didn't obey the law..... Take pity on her ,no I don't feel pity for her .She put her child in danger by not obey the law.

A 4 year old will listen if he knows the punishment will be severe enough. I'll take safe kid over happy kid any day. How about, "If you take that seat belt off - EVER - I will paddle your bare ass". Then follow through with it the first time he takes it off.

I've paddled my kids more times than you can count and hard (not no little taps). Some kids will see something they want and figure they will take the chance of being caught or not. Not everything in life is so cut and dry. But here I'll say it since this is what you want to hear "You are such a better parent than me". That make you happy?

20 year olds don't always make the best choices but the 41 year old certainly knew better and could have made sure her grandchild was in a car seat! I seem to remember my kids' pediatrician used to have information about getting help if you couldn't afford to buy a carseat. I feel if you can afford to be driving a car, you can afford to somehow buy or rent or borrow a car seat to protect your child.
