If a bio parent truely wanted to have visits with child, and in divorce papers visists were at the discrestion of bio parent who has sole custody. Could the bio parent who has no visit rights go to court to get some, and could they get legal aid, if they couldn't afford own laywer? I know someone who is going through this, and absent bio parent acts like they want to see child, but won't go to court to do it legally. Any info would be apprieciated.

get caught up on your back child support. get a full-time job. quit smoking dope. quit posting on your facebook that you're engaged to every guy you have sex with. get a laptop with spellcheck. get a different lawyer than the one you had last time - cause you got screwed big time by the judge, or either it's that obvious you should not be around your own kids.

All very good information. You must prove that you can be a good parent or your children should not be allowed to visit with you. If you love your kids the way you should it's easy being a good parent.

A few things I will add..don't have more kids than you can afford to raise on your paycheck. Don't expect the Federal Government to raise and feed your family. If something happens to you that you cannot work, pay taxes and provide for your children...you stop having babies.

Been there and done that. Yes, you can always go to court. You can take the parent with custody to court for not letting you see your kids. You can take them to court for letting you have them TOO much. You can take them to court for holidays. You can do go to court anytime you want for any reason you invent, imagine, concoct. Legal aid is available to anyone who is being denied visitation. Bottom line, it is just not over until you don't ask. You can even represent yourself. Seen it many times.
If the divorce is final, then petetion the court. Easy enough. If you need forms or advise, much is online and legal aid is available. Ideally, the best bet is to get along with the parent with custody and be respectful of their schedule and the child's best interest.

why would the judge not provide a stronger provision for 'vistation'? Is this a civil-union case? Because it takes a male daddy and a female mommy at the minimum to create a stable home to raise a child. I can see where a judge would not require visitation if this were the case.
Maybe you can't do it after all!
