I am trying to frame the areas so as to get a better perspective.

Sutton's Bay: Is this the Golf Course that was built in Sully County?

Whitlock Bay: Was it East or West Whitlock?

River's Edge: Is that by Bob's Steakhouse?

Rivers Edge is on the right, right before you go over the bridge on old hwy 212, below Bobs resort.
That is where the theft occured, the lotlord there had broke into my home and stole items, then screwed the doors shut and padlocked, I had to break into my own home to get in. It took me over two years to pay for it, I didn't even buy it from him, It was bought on contract for deed from Joel Archer. Talk about the American dream, not in Potter County thats for sure.

Were you current on your payments when the lotlord screw the doors shut?

If this was a seizure and foreclosure, there should be a case file in the Potter County Court House.

I am going to check this with the court records.

I had bought my home contract for deed,It took me over two yrs to pay it off, I received the title for my home in 12/2006, Brad took me to court for back lot rent, he wanted over 2,000, I filed countersuit, judge wouldn't even hear it, Sheriff says because Brad has judgement against me, he (Sheriff) owns everything I own. Wouldn't even let me pay my 2007 taxes, but I had always paid previous years. Sheriff sent me papers saying he was auctioning my home and personal property to highest bidder front steps of Potter Co. courthouse at 1pm 2/4/2008. I think he done this because he didn't want to pursue the breaking and entering and theft if my property, I filed papers on this because items where stolen that only Brad would want. I also filed homestead exemption. Courts took my $ and even gave me a docket number, then later sent it back to me saying I couldn't file. Pierre officials say it's just finding the right person, if the law isn't it, who is it? The Potter county states attorney knows of this. When I filed papers with Sheriffs department, Sheriff McCain says I'm just retaliating and that Mr. Ware is going through bad times,and that I was on welfare, I paid my taxes and took care of my brother, also had to keep up homeowners insurance on my home.I just can't believe the law hasn't worked for me in Potter County, I know every county is not like this. My brother was extradited from Brown Co. to Desmet for over 6 dollars. The American Dream in Potter County is by know means to be living.

djp... sorry, there isn't much you can do. the court had an order of payment on something, and the sheriff took the property to make good on whatever the negative ammount was. sucky situation, but there isn't much you can do. an execution is a court order to the sheriff (meaning that if he doesn't do it, he can go to jail) to sieze any property to make good on whatever you owed.

I really don't undserstand the system, but I do know it's against the law to have the lotlord of the property( where my trailer was sitting) to break into my home while I was away and then board it up plus stealing items out of my home then the Gettysburg,SD sheriff not doing any thing about it, I know this is a small community and corrupt for not going by the law, Bill of rights states that you are allowed to own a home not have it taken away from you, I had signed papers with the sheriff for homestead exemption, I will never get over this, I had worked hard for buying the home even used my 401k retirement monies and then to loose everything in it too, it's just unexeptable, Potter County SD corruption is what I call it. I would never, ever recommend anybody to move to Gettysburg, SD.

well, if you don't know the law that well, what is to say that it was completely legal. corruption only takes place when you use illegal means to gain something. i'm sure the sheriff doesn't take land unless he is ordered to do so. from what i know of him, he's a pretty nice guy... unless you break the law i suppose.
