Florida - Birth Battle: Couple Says Surrogate Mom Won't Give Up...

If the Lamintina's want a child, thier are many unwanted and needy children out there that need a home.. Go adaopt one that needs love and leave this woman alone.. She obviously changed her mind.. Buyihng a baby is illegal.. It is called slavery to buy a human being..

And pay your child support.. You owe it.. You knew what you were getting into when you started all this in the first place.

How can someone be so selfish and cruel using an innocent baby to extort money from a couple who all they wanted was there baby girl. What has the world come to?

i believe that this woman should keep the baby and retain full custody. And i believe the father should pay child support, after all it is his child too. The baby belongs with his birth mom, and this couple should think about adopting a needy child.
I see no difference in this fack about custody and the child support thing, if the guy cheated on his wife and got her pregrent why he would have to pay and lose custody, so it's almost the same thing, he wasn't really there for her when she carried this baby and really needed some one there for love kindness and support, nope it's kind of like that. LEAVE MOM AND BABY ALONE, GO ADOPT A NEEDY CHILD they need love too. maybe more then you realize

Adoption is not as easy as it seems. It takes years and lots of cash way more then you think. This is there baby not her's she is a evil person stealing this baby from loving family. She is only after money and the baby is a side note.

Honestly, if the law says the birth mom gets to keep the baby , so be it. But the court also severed the dad's parental rights. So he has no rights? he is just a sperm donor? But sperm donors don't have to pay child support. Either he is the father or he is the sperm donor. So if he is the "father" and he is going to pay child support, then he needs to have his share of custody. And if he is a sperm donor with no rights, then they can't expect him to have responsibilities too.
This story is as old as time. In 1987 Mary Beth Whitehead won custody of her baby. Couples should know better than to go that route.

The child came from her egg and her body. How can they expect her to give up her child? They should have used a different egg. I could never give up my genetic and physical child. It would cause me incredible pain. Why do people expect birthmothers to feel nothing?

There are proper ways going about serogacy, why didnt the couple follow them? Then this wouldn't be an issue. I think serogacy is a beautiful thing and a wonderful gift to give to a loving and hopeful couple. It is sad that there are people who would do anything just to have a child of their own and medically can't, yet there are tons of drug addict and ppl who dont even want the kids they have. Adoption in the U.S. has way too much red tape. I knew a couple who were on "the list" for 13 years and they finally decided that they have waited long enough and it was time to be removed, 2 days later they got a call that they were getting a 2 day old baby girl.... reason the mother gave the child up, because she was a girl and she wanted a boy! Talk about a blessing for the couple I knew, right when they gave up hope after waiting years and years there call was answered.

I believe that if these people had a legally binding contract with the surrogate, that the contract should be upheld. The surrogate is an adult, and was aware of what she was doing...there is no backing out after you have committed to something like this, and in the process, she is ruining 2 people's lives by destroying their hopes of a child. Florida has some of the most f*cked up legal systems in the US...and this just goes to prove it once again.
The PC thing to say is that yeah....they could just go adopt one of the many children that are in the system right now... The absolute blunt truth is, you don't know what your getting when you adopt, you don't know if the 'stock' the child your letting into your home is from a murderer, molester, or lawyer...and you know that your blood isn't running through the child...sorry to seem so cold hearted, but that's honesty... At least with the surrogate, he knew that his bloodline was going to be continued...and that 'his' child was going to be taken care of...

Thank you JayRob, you are the only one with any sense. They signed a legally binding contract that was overturned by the courts. The woman knew she was going to have a baby for someone else and that they were going to take the baby when it was born. There is no gray area here. The woman knew from the start what she was doing, she knew the law, unfortunately the couple didn't. This baby is just a tool for money, and I hope that woman doesn't get penny one from that family. Although, I know if she doesn't, that child will grow up unloved and neglected because the child wasn't really the goal for the woman, only the money. She is a total scumbag and that is all there is to it.

hey, i believe in adopition, not all kids are bad,. don't you know that you can't pick and choose your birth parents? guess not. Just how many good people are out there that were adopted and living good decent lives? And again, how many good people are out there that have birth parents that have killed, raped, robbed, or threatened innocent people? See, what i'm trying to say, check your closets, and don't be so fast to judge a child, they may just surpise you. My mother was adopted and was a great woman, and you don't even want me to get into her past, not that i would, and now my childrens father was adopted also. I am a mother due to a surrogate. I dont understand how this could have happened if BOTH of them had attorneys. The attorney for the "intended parents" has the responsibility of making sure all legal documents are in order before the surrogacy even takes place. Our attorney had all parties involved in the surrogacy sign legal documents in front of her. There is always a chance that the surrogate can "change her mind" but that's a choice you have to make involving trust. TOLD by our attorney "since we went into this agreement, the surrogate wouldnt have a chance, IF the papers were signed".. So, someone needs to be liable for the legal documents not being signed!!

You are incorrect on the Baby M case go to wikipedia.org the entire case of the Baby M story is on there.The Stern's which were the IP's in that case were given primary custody of the child and Whitehead the SM got visitation only. Didn't know if you got the names mixed up or not but the IP's won their case in this situation but this case was different than the Lamitina case in that the SM did sign the contract that was written by an attorney but revoked at the end after giving birth. I think Whitehead actually fell in love with this baby unlike the Lamitina case where the SM never signed the contract from the beginning so obviously did not intend to go through with the surrogacy from the beginning.

Surrogacy is something you have to be sure of if your not sure, don't do it! They are not being payed to do or begged to do it, so why jump into to something your not sure about just to hurt people in the end. These peole are already devasted and been through so much to have a child and she just turned the knife and pushed it in even more.

Actually, it is his baby and the biological mother's. His sperm, her egg, no signed contract, Florida Statue that allows a biological mother to change her mind. The judge up held the letter of the law, as is his duty.

its redundant and stupid to sign surrogate contracts in florida because if i understand it right, they cant be enforced...so go to another state..adopt..or find someone you can trust.
